PESHAWAR, Nov 23: District and sessions judge Hayat Ali Shah on Saturday ordered the police to register an FIR against Yekatooth-1 union council nazim for demolishing a graveyard.
The court accepted an application filed by an inhabitant of Gulberg, Malik Shabir Ahmad, stating that Nazim Mohammad Shah was demolishing a graveyard in Beri Bagh area and constructing a car park there.
The applicant stated that his ancestors’ graves were in the graveyard.
He stated that a few days back the nazim had started levelling the graves and demolished the wall of the graveyard to widen the way to his home.
He alleged that the nazim had included portions of the graveyard in his residence for parking.
He claimed that he had filed an application with the Yekatooth police station but the police had not registered an FIR.
The application was filed under Section 22-A of the Criminal Procedure Code, under which the court is empowered to act as the “justice of peace” and order registration of an FIR on an application by an aggrieved person. The court asked the police officials concerned why had they not entertained the application.
