SHC orders inquiry against two SHOs

HYDERABAD, Nov 15: The Sindh High Court, Hyderabad circuit bench, on Thursday appointed the sessions judge, Dadu, as an inquiry officer to take action against police officials if they were found guilty of keeping a man in illegal detention.

The inquiry was ordered during the course of hearing of a criminal miscellaneous application, filed by Bibi Birhamani, seeking recovery of her son.

Ms Birhamani filed her application against the SHO, Khanote police station, and the SHO, Wadah Chahchar police station.

The habeas corpus application was filed by the woman on the ground that her son, Sher Mohammad, had married Shabana and she had sworn an affidavit to this effect.

She said that later relations got strained between the parties and a heavy contingent of police took away her son on the instance of Shabana’s father on Oct 26, and added that the detenu was being kept in wrongful detention and being tortured.

She prayed the court to issue a rule nisi for recovery of her son.

The SHO, Khanote police station, said that he did not pickup the applicant’s son as he was not required in any case.

The SHO, Wadah Chachar police station, however, told the court that a crime No8/03 was lodged against the detenu under sections 11/16 of the Zina Hudood Ordinance, 343 PPC on the complaint of one Shahid Ali, and added that he had handed over the FIR to the investigation wing.

The in charges of the investigation wing of the two police stations filed their statements before the court stating that the detenu was arrested on Nov 4 after registration of a case on Sept 2.

The in charge, investigation, Khanote police station, ASI Arbab Ali Khan Khoso said that the FIR was investigated by Sub-inspector Mohammad Ismail Solangi and ASI Asghar Birhamani and an interim charge-sheet was produced by him.

He said that after arrest of absconding accused, the detenu obtained his remand on Nov 7 saying that the charges in the application were wrong.

The in charge, investigation wing, Waddah Chachar police station, Anwar Panwhar, in his statement said that during the course of investigation of a case he found Sher Mohammad, who was an absconder in crime No8/03, in the Giderji forest, and added that Sher was apprehended.
