LAHORE, April 16: A division bench of the Supreme Court on Wednesday set aside the provincial service tribunal order dismissing a headmaster, Basharat Ali.

The counsel for the appellant, Pervez Inayat Malik, argued that his client had been dismissed by the special education secretary despite the fact that only the administrative secretary could proceed with disciplinary action against an employee of the education department in BPS-17 and above.

Punjab Advocate General Syed Shabbar Raza Rizvi also supported the appellant’s contentions, saying that only authorised public office holders could take disciplinary action against education department’s employees in BPS-17 and above.

While setting aside the orders of the Punjab service tribunal, the SC directed the authorities concerned to consider the case afresh and proceed in accordance with the law. — Reporter
