PESHAWAR, March 15: The Peshawar High Court on Friday sought medical report of a former MNA, Haji Mohammad Kabir, from the Armed Forces Institute of Cardiology, Islamabad, in connection with his bail application.

The bench comprising Justice Malik Hamid Saeed fixed March 22 for the next hearing and directed Advocate-General Qazi Rasheedul Haq to produce his power of attorney from the National Accountability Bureau for his appearance in the case.

Appearing for the applicant, Barrister Zahoorul Haq stated that he had been undergoing medical treatment in AFIC. The applicant was convicted by an accountability court of possessing illegal assets. However, an appellate bench of the high court set aside the verdict and remanded the case back to the accountability court for a re-trial.

The applicant has been suffering from cardiac ailment. He was imprisoned at the central prison in Haripur, but was shifted to AFIC when his health deteriorated. When his case was remanded back to the trial court, NAB through the home department requested that the applicant be shifted back to Haripur. The concerned doctor, however, declined the request on the grounds that he was not in a position to be shifted to the prison.

On Friday, Qazi Rasheedul Haq informed the court that he had been assigned the case, but his power of attorney was yet to arrive. The court directed him to produce the same on the next hearing.

Barrister Zahoorul Haq suggested that in the meantime the medical report of the applicant should also be asked for.
