KARACHI, Dec 3: The hearing of a constitutional petition filed by former chief justice of Supreme Court of Pakistan, Justice Syed Sajjad Ali Shah, commenced on Monday before Sindh High Court’s Justice Sabihuddin Ahmed who is hearing the petition as a referee judge.
The petitioner has sought fixation of his pension as CJ of the apex court and not as fixed as a judge of SC.
Earlier, a bench of SHC, comprising Chief Justice Saiyed Saeed Ashhad and Justice Zahid Kurban Alavi, gave a dissenting judgement. The CJ of SHC dismissed the petition while Justice Zahid Kurban Alavi allowed the petition on ground that even an acting CJ of the apex court was drawing pension as CJ of SC while the petitioner has remained the CJ for a considerable period of time.
When the petition came up for hearing, DAG Syed Zaki Muhammed requested for an adjournment on which Justice Sabihuddin put off the matter till Dec 24.
Another bench of SHC, comprising Justice Ghulam Nabi Soomro and Justice Ata-ur-Rahman, summoned the SSP of Railway in a constitutional petition filed by one Azizullah.
The petitioner alleged that the railway police had detained five persons. The bench appointed Nazir of SHC to conduct a raid and recover the alleged detainees. The raid was conducted by Deputy Nazir who recovered the alleged detainees and released them.—APP
