KARACHI, June 20: A sessions court on Monday directed the town police officer of Bin Qasim Town to take departmental action against some policemen involved in a wrongful confinement case.

On a directive of the sessions judge, a judicial magistrate raided a police post of the Bin Qasim police station on June 17 and recovered a man from the lock-up.

After hearing both sides, the judge in charge of the district and sessions court (Malir), Farzana Mushtaq, disposed of the habeas corpus application and directed the Bin Qasim TPO to complete an inquiry, take stern departmental action against the responsible policemen and submit a compliance report.

The station house officer appeared in court and said he was unaware of the detention of the victim.

He produced four policemen, said to be involved in the unlawful confinement of the victim, in court and submitted that the TPO had suspended these men and an inquiry in this regard was under way.

On a previous hearing, Judicial Magistrate Naveed Asghar submitted his report in court stating that he along with the applicant and his lawyer carried out a raid on the Naseerabad post of the Bin Qasim police station. The police had tried to shift the detainee, but he managed to see the fleeing policemen and recovered the victim, the report added.

The magistrate stated that the detainee was wrongfully confined at the police post and the policemen had failed to produce any document to justify his detention.

Earlier, Sikhu filed a habeas corpus application under Section 491 of the criminal procedure code stating that a police team broke into the shop of his cousin, Nisar, a scrap dealer, deprived him of cash and valuables and took him to the Naseerabadpolice post.

He alleged that the police demanded a bribe for his release.

Meanwhile, the district and sessions court (central) issued a notice to a shelter house on a habeas corpus application.

Mohammad Khan submitted that the parents of his cousin, Farmana, were killed in Waziristan and she went missing.

He maintained that in April this year he came to know that she was ‘detained’ at a shelter house within the remit of the Gulberg police station.

He said he approached the shelter house, but its management allegedly stopped him from meeting his cousin.

The court issued notices for June 22 to the official in charge of the shelter house as well as the SHO concerned with a directionto produce the respondent and the victim in court on the next date of hearing.
