KARACHI, Jan 22: A sessions court (east) on Saturday sentenced three men to five years in prison in a robbery case.

The court found the three men — Wasiq Anwar, Rehan Ali Khan and Aghaz — guilty of breaking into the house of Saud Yousuf and robbing his family members in Nov 2008 in Shah Faisal Colony.

Senior Civil Judge & Assistant Sessions Judge (east) Sarwat Sultana pronounced her judgment after recording testimonies of witnesses and final arguments from both sides.

The court also imposed a fine of Rs20,000 each and in case of non-payment the convicts would have to undergo an additional two-month imprisonment.

According to the verdict, all the witnesses had testified against the accused while an eyewitness rightly picked out the accused during an identification parade as well as before the trial court.

It added that the prosecution successfully proved its case against the accused beyond a shadow of a doubt.

According to the prosecution, on Nov 29, 2008 the accused broke into the house of Saud Yousuf, held his family at gunpoint and looted cash, jewellery and other valuables. Later, the accused were arrested in another case.

A case (FIR 428/2008) was registered under Sections 395 (punishment for dacoity) and 34 (common intention) of the Pakistan Penal Code at the Shah Faisal Colony police station.

The accused were produced in court in custody and the judge remanded them back to prison along with conviction warrants to serve out the remainder of their sentence.

Man jailed for three years

A judicial magistrate on Saturday sentenced a man to three years in prison in an unnatural offence case.

The court found Maula Dad guilty of committing an unnatural offence with a 13-year-old boy in Aug 2005 within the remit of Mauripur police station.

The court also imposed a fine of Rs45,000 and in case of default the convict would have to undergo an additional six-month imprisonment.

A case (FIR 179/2005) was registered against the accused under Sections 377 (unnatural offences) of the Pakistan Penal Code on a complaint of the victim's father.

The accused, who had been enlarged on bail, was present in the courtroom and taken into custody following the pronouncement of the verdict. He was sent to jail to serve out the sentence.
