ISLAMABAD The Islamabad High Court dismissed on Friday a habeas corpus plea over the alleged detention of nuclear scientist Dr Abdul Qadeer Khan, observing that the matter had already been decided by it.

The single bench of Chief Justice Sardar Mohammad Aslam also ruled that the Supreme Courts decision over Dr Khans alleged detention case had explicitly stated that only his wife or blood relatives could file a plea if there were any grievance.

He told Barrister M Javed Jafferi, the petitioner, that he had no authority to further interpret the apex courts verdict.

"The IHC has decided the main petition and you have accepted it, the subsequent two review petitions were dismissed on the subject of maintainability, now stop further litigation in the matter,” the chief justice added.

He said Dr Khan in interviews to media had been expressing his lack of confidence in courts.

“Why is he shy of filing pleas himself in black and white? He should file the plea if he wanted provision of pre-February, 2004 security arrangements,” he said.

Regarding Jafferis plea about restrictions on visitors to meet Dr Khan, the Chief Justice replied that he was being provided the required medical treatment of his choice, besides being taken to dinners.

“I had asked you to submit a list to the court of those who wanted to meet Dr Khan, but you never did,” he added.

Jafferi said the government should be asked to apprise the court about the written orders under which Dr Khan was incarcerated.

He told the court that he was informed by the Ministry of Interior that Dr Khan was detained on the verbal orders of former President Pervez Musharraf.

He said even Mehmood Ahmed, a retired general, was denied access to Dr Khan.

Meanwhile, the chief justice also refused to entertain another plea over Dr Afias alleged extradition to US.

He said neither the case was fixed for today nor he had any file about his fresh plea.

He asked Jafferi to wait for the hearing of main petition over Dr Aafias case, if he want to argue.

According to the APP, in his new application, Jafferi sought assistance of Chairman Senate Functional Committee on Human Rights SM Zafar in Dr Aafias case, being heard by the IHC.
