KARACHI, April 28: The Supreme Court was moved on Wednesday for leave to appeal the Sindh High Court order in the Shaista Almani case. Petitioner Khuda Bakhsh Almani submitted through Advocate Ghulam Qadir Jatoi that right from the first day the proceedings of the case were not confined to the parameters laid down by the constitution for the exercise of writ jurisdiction.

No detailed inquiry could have been held in the plea for production of the alleged detainees. The petitioner was "allowed to be humiliated by the non-governmental organizations" in the course of the proceedings.

The recording of the statements of the alleged detainees was also not fair. The petitioner's name was unduly deleted from the list of respondents, he maintained.

An SHC division bench had declared Shaista Almani and Balakhsher Maher 'sui juris' on March 30 and allowed them to decide on their future relationship as legally competent citizens. It did not rule on the validity or otherwise of their marriage as the issue was not before it for adjudication.
