From The Past Pages Of Dawn: 1968: Fifty Years Ago: Shorish Kashmiri case

There was no issue of the newspaper on Sept 11, 1968 on account of Quaid-i-Azam’s death anniversary. The following extract is from the previous day’s issue.

KARACHI: Attorney-General of Pakistan Syed Shariffudin Pirzada continued his arguments on the legal point whether the High Court has jurisdiction to look into the validity of a person’s detention, when the full bench of the Supreme Court resumed hearing of the Shorish Kashmiri case in Karachi yesterday [Sept 10].

The legal point challenging the jurisdiction of the High Court was raised yesterday by Mr. A.R. Changaiz, Advocate, appearing on behalf of the Provincial Government which has filed an appeal before the full bench of the Supreme Court headed by the Chief Justice Fazle Akbar against two orders of the West Pakistan High Court passed recently in the Shorish Kashmiri case.

During the proceedings the Attorney-General cited precedence from the constitutions of Ireland, Australia and other Commonwealth countries to explain the extent of powers of the executive during state of war. Published in Dawn, September 12th, 2018
