Court acquits Sharifs in money laundering case

RAWALPINDI: An accountability court on Friday cleared Prime Minister Nawaz Sharif and Punjab Chief Minister Shahbaz Sharif of all charges pertaining to a money laundering reference filed 14 years ago.

During a hearing presided by Justice Anwar Ahmed at the National Accountability Bureau (NAB) court, Sharif brothers, along with Kulsoom Nawaz, Maryam Nawaz and Hamza Shahbaz, were acquitted from all corruption charges in relation to Raiwind palace, Hudaibya Paper Mills and possession of illegal assets.

Justice Ahmed said the cases had been pending for 14 years and not a single witness had appeared in court.

Terming the charges against the Sharif family as politically motivated, the court said these had no factual bases.

However, another reference accusing the Sharif family of defaulting over a bank loan in relation to Ittefaq Foundries is yet to proceed in the accountability court.

The hearing of the case was subsequently adjourned to October 2.

Earlier in 2000, the General (retd) Pervez Musharraf-led government had prepared a money laundering reference against Pakistan Muslim League - Nawaz (PML-N) leaders Nawaz Sharif and Shahbaz Sharif.

The reference had said that the Sharif brothers had used the Hudaibya Paper Mills as a cover for money laundering during the late 1990s.

The ruling comes at a favourable time when the embattled Nawaz Sharif is struggling to hold his own with the protesting Pakistan Tehreek-i-Insaf (PTI) and Pakistan Awami Tehreek (PAT) demanding for his resignation and calling his government the outcome of a rigged election.

Pakistan is going through turmoil in every field...up until late 1960s we had nationalism and no matter who ever was at the helm of affairs i.e. civil or military, nepotism was not widespread…which enabled us not only to excel in every field but also to help the newly emerging economies such as China and Malaysia…than we slowly forgot the ideology of our country and nationalism gave way to widespread nepotism and racism...merit gave way to favoritism and incompetence...so we are reaping what our so called leaders sowed...things need to change but in peaceful manner...peaceful change is the lasting change...however unfortunately...Imran Khan and Tahir-ul-Qadri’s efforts do not meet the criteria of a "Game Changer"...

Instead of making sure that the witnesses are produced or if they are not coming task the police to produce them the court did a wonderful justice of dismissing the case as NS must have sent him a big briefcase which told him the case was politically motivated.Why didn't the judge see the signed statement of Mr Ishak Dar in this connection where he has admitted to launder money for these accused ? or is this Judge beyond reproach

Sensible decision by the court. 14 years is enough time for investigation. Bear in mind that NS was not in govt during all this span. In fact, he has been politically very weak in Musharraf regime. People of Pakistan elected NS as prime minster and expect him to concentrate on development of the country. well done Judiciary, you have saved Democracy ("house of Sharifs") songs and praises will be written in the honor of your impartiality and justice. of course in the meantime there is a matter at hand General' Musharraf's case which must be dealt with according to the wishes of "democracy". he did something terrible like declaring the emergency, which is a travesty itself & is much more bigger crime than the killing of over 50,000 Pakistanis he should be punished according to the wishes of house of Sarif since it is not they are all declared clean now so no one call term it politically motivated. he must pay for his sins for fighting the noble Taliban, the BLA and local friendly Imams of Red Mosque.

Any case that moves on the assumption of assets beyond known sources of income against both the Sharif brothers and Asif Ali Zardari (or the Bhutto family) will succeed. None of these people can prove that their assets were acquired through their limited incomes. It is as simple as that.

Name the witnesses - make them appear in international crime tribunal - Whilst I have respect for the honourable courts, Pakistani Supreme Courts have judges selected by Sharifs.. therefore, the credibility of decision will remain doubtful. How can someone tried in a court of law, nominate judges.. there will always be an element of ' returning the favour '. To uphold the law, it is high time that our Courts and Military have their own recruitment process all the way up to the top level. Just like a CEO is chosen in big corporate companies by board members. We must make our institutional impartial, if we want people to trust their actions and decisions.

@Haider Rehman Just to remind you that case was instituted by the military junta and NS was expelled from the scene his close confidante and officers were either thrown out or maimed and there was no sign (apparent one) of his returning to power anytime sooner. Even under such hostile environment the case could not be proved.

To all negative commentators here, You cannot force the courts to give decisions of your choice. Let the courts do the justice as they are best capable of doing so. Sharifs have learned their lesson, hopefully Buhtan Khan and his followers will also learn that obeying the courts is in everyone's best interest. On another note, when will this country start auditing the humongous military budget. This nation cannot afford to pay ISI billions just to see dharnas in the end.

Why one should wonder at the favourable court ruling? After all Zardari had been aquitted in all such "false" cases against him during his tenure and the last days of Musharraf after NRO. Now it is the turn of NS. He and his family and cronies will all get clean chit from courts and dry cleaned. The investigation is done either by FIA or by NAB, headed by their own men. How a judge can prosecute someone when the prosecutors destroys the evidence, if any available on file. We have forgotten what happened to the evidence in Swiss cases against Zardari.

Raymond Baker in his book Capitalism’s Achilles mentions a list of corruption scandals attributed to our current PM (NS), yet PM has never replied back or taken him or taken him to any court. Sharif must have presented all legal bank transactions of money transfers to several accounts used :) No case is dismissed on technical grounds as no witness dared to go against the present government. Once against proven, while in government no court in Pakistan will go against the rulers, proving IK stance for resignation.

The people of Pakistan need to understand that the prosecution of these cases is done by NAB whose head was appointed by Nawaz and Zardari. The judge can only incarcerate an accused if the prosecutor presents a strong case to the judge. Otherwise the judge has no option but to release the accused.

@Parvez It means the courts competency is in question. That competency factor includes the judge. On the other hand I should also consider both sides. These 14 years also include Musharrafs and choudarys time. It would have easy for them to produce a witness if there was any. So on this particular case --- I would give the court benefit of the doubt. Even tho it's hard to believe.

WE DO NOT TRUST CURRENT NAB processes as all main people have been hired by Sharifs. How can they be cleared when Ishaq Dar submitted an affidavit to say money laundering took place. The election, NAB and other processes need to be independent. No politician shud interfere.v

I'm totally against NS. Check my posts. I think he and SS need to resign. They should be investigated. Lap tops and the money should be taken back from Shehzadi Maryam. But----- this case for 14 years includes Musharraf and choudarys rule too. How come they were never able to bring forward any witness ? Or ATLEAST this was a bogus case to begin with. Or sharifs paid money to the witnesses ?? Reasonable questions. Need reasonable answers. Atleast don't do mukhaalfat just because you don't like the person. ( I don't ). However by the same token I say SS needs to be held responsible for model town killings one way or other. Not only resign but prosecuted for either ordering use of force or criminal neglect.

Its a joke. Look up the records of NDFC (National Development Finance Corporation) now National Bank and any intelligent person can see why NAB had a case against the Sharrifs. You don't actually need any witnesses, just the records to convict the Sharrifs. Justice is definitely sleeping in Pakistan. Need to re-vamp the Justice system. Every project officer and senior at NDFC knew who had manipulated and robbed the Company. Shame on NAB too for not convicting and closing all NDFC cases.

I see some people are supporting the fact that no evidence was ever produced even during Musharraf and Chaudrys era. Use some common sense people, when did ever any VIP get any punishment from our courts? What evidence are you talking about? Our system let go the killers of innocent people, they let go LeJ, Taliban terrorists because there was no evidence. Yet, the same judiciary allowed Zia rule for 10 years in the name of Necessacity. Our judges, our system, our government, and even our people are the joke and nothing. I have no hope for Pakistan and our people. We talk about democracy yet our leaders are elected based on their last names and wealth such as Hamza, Bilawal, etc etc etc

@raza Do you need witness_ what nonsense you talking- money is sent by wire transfer- banks. bonds, stocks etc.. For millions of dollars you need witness - like carry a suitcase on bicycle to Hong Kong; or put on truck to Switzerland or load canoe to Caymen Islands.. 14 years -- it took such a long time for judiciary to wake up and dispose the case -

@Parvez My point --- if they couldn't get witnesses during Musharraf and choudarys rule. What makes people think that courts would find witnesses when SS is CM and NS is PM. ( that for sure helped them dismiss the case tho ).

Not only Sharif, any person whose decision could not made in 14 years should be released with honor. Why dont judiciary put a time limit on cases... no case should hang for more than 2 years....

The Sharif brothers are dictators, They have all the possible power to destroy any body. Specially when they have full control on the parliament. army, Police and the Judges. I still swear that they can not survive and will disappear soon with the stupid, who love him. The army is supposed to protect the Pakistan and not the stupid Nawaz.

Cases had been pending for 14 years, this includes Musharraf era. And no witness means there was really no witness at all. The case was politically motivated

Baffling questions, just 2 not more, need truthful answers at least from Saad Rafique or Pervaiz Rashid or Ch Nisar or Begum Kalsoom Nawaz but if none of them replies then of course honourable PM Nawaz Sharif himself to reply, if not annoying. (a) How many cases had been registered against Sharif brothers? (2) How many cases have already been quashed by the courts?
