Court rejects Musharraf's petition against prosecutor's appointment

ISLAMABAD: The special court, which was hearing the treason case against former military ruler Gen (retd) Pervez Musharraf, rejected his application Friday in which he had challenged the appointment of Akram Shaikh as head of the prosecution team, DawnNews reported.

Announcing the court's decision on the plea filed by Musharraf, Registrar Abdul Ghani said the petition was inadmissible for hearing and that the judges had rejected it.

In today's decision, the special court said that the Islamabad High Court's verdict of Dec 23, 2013 had declared valid the appointment notification of Akram Shaikh as chief prosecutor.

Earlier on March 26, the special court had reserved its verdict on the application challenging Shaikh's appointment.

Musharraf's counsel Anwar Mansoor Khan had alleged that Shaikh had expressed his desire to prosecute Musharraf under Article 6 of the Constitution even before the filing of the treason case by the government and before he was even appointed chief prosecutor.

Mansoor had also challenged Shaikh's appointment in the IHC along with filing two other petitions, stating that the appointment was not legitimate.

The court had subsequently rejected his application.

GOVT has decided, and kangaroo courts are just following their instructions and implementing them, they are fooling people, they announce after some days, to show they are impartial, because they are paid for that, so don not expect there will be fair trail

...and they said the 'Adlia' was impartial. It appears the courts backed by Ifthikhar Chawdry is becoming a political party not an independent judiciary. President Musharaf is a brave patriotic Pakistani who will fight on and win. InshAllah.

How surprising! they rejected one of his petitions again!..they just want to convict him so SHORTY can pardon him.this charade of a trial is pure revenge!. My advise to former President is to call a press conference or go on Twitter and talk to people of Pakistan that he does not believe he can get a fair trial.tell them that while the people who have been killing Pakistani people, Pakistani Army and are against the constitution are being set free without a trial and any punishment.I Pervez Musharraf who has served the country and the army for 45 years is being tried for treason. Tell them whatever action you have taken you did that for the country.given the chance you will do it again.you believe in PAKISTAN FIRST!. Tell them that you and your lawyers will attend the trial but will not file any petition or call any witnesses because you don't think you are getting a fair trial and if convicted you will take the death penalty and will not file an appeal because you believe in GHAZI YA SHAHEED!!!.

The more I look into this fabricated case the more I loose the faith upon the judiciary in Pakistan. Although I am not a follower of musharaf so far,but I am ardently against the rhetoric of so call democratic sections of society. Is this the compliance with the spirit of justice? they are morally blind and resilient. They are hired by government in taking the revenge. Why this judiciary becoming the instrumental in personnel war between the nawaz and musharraf. They don not deserve the name "judges" for them. it never suits them at all....I mean this

@nk: You sound like a young chap not able to understand why Musharraf is being prosecuted, I would suggest you read the report of the Hamood-ur-Rehman commission. Then you may begin to understand the context within which he is being prosecuted.

Special prosecutor and special court are trying to do special justice and in the process forgetting the fact that they are proving to be what people expected and were apprehensive about this farce and selective, no special, justice. Shame on this act of vendetta in the name of justice. Shame on this travesty and this public murder of justice and gang raping of rule of law.

The decision of the Trial Court was known well before it was made public. They are there to prosecute Musharraf, not to give a fair trial. That is how named as: "Kangaroos Court". Akram Shaikh is fond of talking loud on TV talk shows. He also, unequivocally, admitted in the TV program

Writing on the walls are not being read by the Government and its backed Judiciary. Straight forward comments,views of Rawalpindi based politician and veteran Hassan Nisar, even views expressed by Asma Jahangir in recent past and many others in favor of Musharraf are being ignored. This is nothing but a clear case of victimization..Episode of 12th October should not be repeated again, take care of this Mr Shareef.

These judjes are all hand picked so they will convict Musharraf one way or the other. Having said that , remember what Musharraf did to Nawaz Shareef when he was overthrown. He should have been shown some consideration , whatever his crime. Reminds me of one couplet by Bahadur Shah Zafar , > **Zafar admi us ko na janiye ga ho wo kaisa he sahib-e-fehm-o-zaka, > jisae aish mai yad-e-Khuda na rahi, jisae taish mai khauf-e-Khuda na raha**

@Akram...Don't try to patronize me...One doesn't need to read any report when the so called "honorable courts" revengeful Government and media says that ONE PERSON imposed the Marshal Law and Emergency on 200 million people without any help!.you can read the writing on the wall!.this has nothing to upholding the LAW,this is PERSECUTION!.

@Akram: I believe @nk is right. Not sure why you brought up the Hammod-ur-Rehman commission - it had nothing to do with Musharraf and its findings have no parallels to what happened during Musharraf's time. That said, our courts are neither known for fairness nor for honesty. They are jumping up and down now but this is the same community that distributed sweets when Musharraf took over the government in 1999.
