Maulana Malik declared elected from NA-41


ISLAMABAD, Sept 29: The Islamabad High Court on Monday declared Maulana Abdul Malik as elected from NA-41 Wana, South Waziristan, (Tribal Areas-VI) in the general elections and set aside the decision of the chief election commissioner.

The two-member division bench comprising Justice Mohammad Munir Paracha and Justice Syed Qalb-i-Hassan announced the short order on a writ petition of Maulana Malik.

The petitioner, an independent candidate, had argued that CEC's notification of August 7 after conducting re-polling on two stations was against the Constitution and the elections rules.

On August 11, the single bench of Chief Justice Sardar Mohammad Aslam had suspended the chief election commissioner’s notification on the constituency.

The CEC had decided to hold re-polling which was challenged by Maulana Malik in the Supreme Court of Pakistan. The apex court referred the case to the CEC and the latter ordered re-election on two polling stations.—APP
