ISLAMABAD, May 26: The Islamabad High Court (IHC) Monday served notice on Pakistan Television (PTV) Corporation over the appointment of director administration with a direction to apprise it of the relevant facts till June 11.
The single bench comprising Chief Justice Sardar Mohammad Aslam heard a writ petition filed by Mazhar A. Shah through his counsel, Ibadur Rehman Lodhi.
The petitioner apprised the court that he was removed from the post after outside interference and appointed director PTV Foundation.
He said in his place Director Personnel and Security Ahmed Sajjad Jaspal was appointed director administration, whereas only a person having MBA or MPA degree was eligible for the post.
After hearing his arguments, the IHC chief justice issued notices to the respondents.
, a division bench comprising Chief Justice Mohammad Aslam and Justice Raja Saeed Akram Khan reserved judgment in a plea for transfer of a murder case to Anti- Terrorist Court (ATC).
The court was told that a murder took place at Sahi Chowk on February 24, 2006, in which a man, Shahid Mehmood, lost his life.
Counsel for the complainants Malik, Rabnawaz Noon advocate, contended that the case should be transferred from the trial court to the ATC. A case was registered against seven persons, but their trial was being conducted at the trial court, he added.
The counsel for the federation strongly opposed the plea and said it was not a case to be heard at an ATC.
SHERPAO’S PLEA: The IHC on Monday adjourned till June 4 the hearing in former interior minister Aftab Ahmed Khan Sherpao’s writ petitions regarding cases pending with an accountability court, Rawalpindi.
A division bench comprising Justice Mohammad Munir Paracha and Justice Syed Qalb-i-Hassan adjourned the hearing with a direction to the National Accountability Bureau (NAB) to apprise it about transfer and appointment of a judge of trial court. The former minister had filed three writ petitions in the IHC. On May 6, the same bench had accepted Sherpao’s plea requesting exemption from personal appearance at the accountability court. Hearing in the two other petitions was adjourned with direction to NAB to submit reply.
Mr Sherpao’s counsel had pleaded that the cases had been pending for a long time with the accountability court as the judge had been transferred.
He prayed to the court to issue notice to NAB over the delay in appointment of a judge to hear his cases.
Separately, a single bench comprising IHC Chief Justice Mohammad Aslam directed the Ministry of Education to regularise the services of three female contract teachers.
Naveed Tahira, Nadia Sharif and Nazia Siddiqui had filed writ petitions through their counsels Ali Murad Baloch advocate and Shoaib Shaheen advocate.
DISSOLUTION OF NALA: The Islamabad High Court (IHC) here Monday adjourned till June 4 the hearing in a writ petition seeking dissolution of the Northern Areas Legislative Assembly (NALA).
A single bench of Justice Syed Qalb-i-Hassan heard the writ petition filed by Syed Mohammad Ali advocate through Mohammad Ibrahim Shahid advocate.
The petitioner apprised the court that before its current status, NALA was called the Northern Areas Legislative Council (NALC) and it worked under the Ministry of Kashmir and Northern Areas.
He said its members were not allowed to legislate or have the authority to prepare the budget. But the notification issued by the government changed their whole status. The erstwhile status of the council was changed into assembly, while the deputy chief executive had been given the full powers of chief executive, he added.
He contended that members who took oath before the change should cease to perform their duties. They were the members of NALC only and after amendments continuation of their services was against the constitution, he argued. Mr Ali sought dissolution of NALA on these grounds.
Another single bench comprising Chief Justice Mohammad Aslam reserved judgment in the removal of a name from the Exit Control List (ECL).
The writ petition was filed by Syed Ijazul Rehman, a retired major, through Saleh Mughal.
The counsel apprised the court that Mr Rehman had served in Pakistan Army from 1960 to 1997 and afterwards and also served as principal security officer at the Pakistan Atomic Energy Commission (PAEC) during 1997 to 2001.—APP
