LAHORE, Jan 29: The local consumer court has ordered manufacturer of rickshaws and the Small Industries director to take back a defective rickshaw from the petitioner and pay him Rs37,900 within 10 days.

The judge issued the direction on a petition by Mushtaq Husain of Multan Road, Lahore.

Husain said he got on lease a new four-stroke CNG rickshaw in April last from Pak Tetra Auto Rickshaw Industries, Peshawar, through its dealer, Malik Nasir Kamal, of Lahore and Small Industries’s Lahore director.

He said from the day one, the rickshaw was not fit for public service, and he had spent Rs100,000 on its repair. He said he had time and again contacted the respondents to redress his complaint, but they remained unmoved.

He prayed the court to direct the respondents to pay him Rs120,000, including the money he paid to the company, repair expenditure and mental damages.

Accepting the petition, the judge said the respondents were bound to pay the petitioner Rs16,000 of first installment, Rs4,500 of registration fee, Rs2,400 under the head of repair, Rs10,000 lawyer’s fee along with the cost of the case worth Rs5,000.

The judge said the petitioner was not entitled to any damages as he had failed to pay the remaining instalments. The petitioner would return the rickshaw to the Small Industries, which would give it to the company, the judge said.
