HYDERABAD, Nov 22: The Sindh High Court, Hyderabad circuit bench, has issued notice to builders of Shams Basheer Heights on public interest litigation filed by Dr Mohammad Ali Cheepa and nine other residents of Roop Mahal Hirabad.
Petitioners said the building was being constructed by Al-Naseer Associates of Raees Ahmed Sheikh and Mrs Fahmida Raees Shaikh as per advertisement. They said construction of shops and marketing area in a residential area on rear entrance of Roop Mehal Hirabad will infringe upon the privacy of residents. They said utilisation of drainage/sewerage line, property of Taluka Municipal Administration was extension of Shams Basheer Heights.
They said it will obstruct ventilation and sunlight of the rear side of Roop Mehal and this extension was reserved for bathrooms and toilets facing windows of residents of Roop Mehal. Bathrooms will stench the area.
They said sanitation and drainage will cover at least 1-2 feet from the lanes less than 20 feet wide, in addition to already occupied TMA system.
They said installation of elevator indicates the building to be more than three-storey high sans fire fighting system.
They said there was one main water supply/opposite Hesco office near Allah Wala Chowk for the vicinity which will snatch their share as underground tank of the project will be filled by it.
They said the area was hit by inadequate parking facilities and parking of vehicles in two lanes would block main entrance.
They prayed the court to intervene and stop illegal construction of the project on city survey plot no A-352/1 and A352/2 situated on rear side of Roop Mehal Hirabad and issue directives to Building Control Department to provide necessary documents and layout plan.
Meanwhile the Sindh High Court, Hyderabad circuit bench, has issued notices to authorities of the Building Control Department, builders of Medina Arcade and dealers of cellular phone companies on a civil miscellaneous application filed by Mohammad Amjad, praying the court to stay approval of building plan of Medina Arcade and recovery of payment from allottees in Medina Blessings.
The applicant who appeared in person in the court referred to June 6, order of court in his application, whereby court restrained Arif Builder from raising construction over disputed plot except strictly in accordance with building plans approved by the competent authority.
He then filed two miscellaneous applications in his main petition citing Director Ejaz Hussain, Director Faisal Zafar, Director Awais Ahmed of United Mobile Zone, Jamil, Iftikhar of Mobile Zone Hyderabad as respondents, besides Director Excise and land grant officer. In one such application (MA-1653/07), he stated the mobile dealer of Karachi of collecting millions of rupees from people for booking of shops in ground and mezzanine floors of Medina Blessings without obtaining permission from Building Control Department (BCD). He said the BCD officials were involved therefore, an inquiry should be conducted.
In his fresh application he said the recovery of payment from allottees should be stopped and approval of building plan on city survey nos F-8/1 to 8/5 of Medina Arcade should also be stopped. He said builders and the project director wanted to put people into litigation by making recovery of payment from them. He said until his applications were decided permanent injunctions should be issued to meet ends of justice. The court issued notices to other side for November 30.
