HYDERABAD, Nov 18: The Hyderabad circuit bench of the Sindh High Court has restrained DPO Tando Allahyar and SHO Tando Allahyar police station from taking any coercive measures against petitioners Mohammad Ramzan and Zulfiqar Ali.

It also issued notices to Additional Advocate-General (AAG), DPO and SHO Tando Allahyar and private respondent Abdul Hakim for November 20 on the joint constitutional petition.

The petitioners said that Abdul Hakim had lodged a case with the Tando Allahyar police station, on September 13, 2007 under section 365-B and 366 PPC against one Mohammad Khursheed and Mohammad Asif. They said that complainant maintained in his FIR that accused kidnapped Saima, the niece of complainant and daughter of one Mohammad Ali adding that Khursheed and Asif took away her in a car. They said that witness Mohammad Aslam Mughal and Mohammad Jameel Mughal tried to foil the attempt but failed.

They maintained that Khursheed and Saima are still underground and have not been recovered by Tando Allahyar police since then and relatives of both sides are also worried and trying to ascertain their whereabouts but couldn’t succeed. They said that it was reported by Saima’s parents that she is in contact on mobile phone with her parents but they are silent.

They said that police during investigation failed to recover both of them to date but were picking-up family members of petitioners. They said that police picked up Mohammad Ramzan and his brother- in- law Mukhtiar Ali, petitioner Zulfikar Ali and his brother-in-law Mohammad Asif.

They said that Tando Allahyar police were harassing petitioners and issuing threats to them. They apprehended that police might arrest them in the case. They said that contents of FIR revealed that eye witnesses Mohammad Aslam Mughal and Mohammad Jameel Mughal, who saw Khursheed, Asif and Saima in the car and screamed but despite listening to them Saima didn’t stop or give any indication as if she is being kidnapped.

Thereafter, they said, affidavit of free will by her was filed before magistrate thus section 365-B and 366 PPC could not be attracted in case but police lodged FIR under influence against Khursheed and Asif.

They said that since lodging of FIR on September 13 police intentionally didn’t make efforts to recover Khursheed and Saima although two months had lapsed. They maintained that police were harassing petitioners and their relatives. They prayed the court to direct police not to harass, humiliate and tease victims illegally.
