Contempt notices served on housing society


ISLAMABAD, Oct 18: A court in Rawalpindi on Thursday issued contempt notices to the management committee of Airport Employees Cooperative Housing Society (Airport ECHS) for not implementing court order passed on October 5, 2007 and adjourned the matter for October 29.

Hearing the case and contempt application submitted by Ch.Iftikhar Ahmed, a member of the Housing Society, the Civil Judge Ambreen Qureshi expressed her displeasure over the non- implementation of the order and directed all the respondents to submit written reply before the court that “why the court order were not implemented”.

Munir Ahmed Kiyani advocate appeared before the court as counsel of the petitioner/applicant apprised the court that the order passed by the court on October 5, 2007 were not implemented even after two weeks.

The counsel of the applicant also informed the court about the non-implementation of the order by the District Officer Cooperative, Rawalpindi, Mir Ahmed Shah and requested the court to take notice against the responsible officials/persons in accordance with law for violating judicial order. The applicant had told the court that the elections of the society were held on July 22, 2007 in violation of the previous order passed by the civil judge on July 18.

According to the applicant even the notification of the election was issued by the District Officer Cooperative, Rawalpindi in contravention of bye-laws and without prior approval from the competent authority (the Registrar).

The court had restrained the Management Committee of the Airport Employees Cooperative Housing Society (AECHS) from performing its functions through order passed on October 5, 2007 till further order.

The court was also apprised that the Circle Registrar (Housing) of the Punjab Cooperative Societies, Lahore, had already cancelled the September 30 annual general meeting of AECHS by declaring it illegal.—APP
