KARACHI : Notices against MLOs issued in murder case

KARACHI, Oct 9: The additional district and sessions judge-II, Central, Nelofer Shahnawaz Azimi, on Tuesday issued notices against two medico-legal officers of the Abbasi Shaheed Hospital for not appearing in court to testify in a murder case.
According to the prosecution, accused Mohammad Younus, son of Mohammad Roshan, after a brawl with Mohammed Ghayas stabbed him to death on Aug 28, 2001 in the limits of Super Market police station.
The judge in a letter to the Sindh health secretary complained that the MLOs concerned Dr S. Zafar Shah Khan and Dr Sarfraz Gul were not appearing in the court to testify as prosecution witnesses.
The court directed the health authorities to ensure the presence of these doctors on Oct 22, the next date of hearing as the Sindh High Court had also ordered early disposal of the case in question.
According to the prosecution, eleven witnesses have so far testified in the case but the investigation officer Inspector Mohammad Nawaz was also not appearing in court.
The other witnesses who have failed to appear in court include Judicial Magistrate Ayaz Mustafa Jokheo, Sub-Inspector Abdul Khaliq, Head Constable Aazadar Hussain and Mohammad Naseem. The court has also summoned the witnesses.
A case (FIR No 84/2001) was registered at Super Market police station against the accused Mohammad Younus under Sections302 of the Pakistan Penal Code.
Arrest warrants
The additional district and sessions judge, Judicial Complex, Ghulam Rasoom Sammo, on Tuesday issued non-bailable arrest warrants of two police inspectors, Ali Murad and Abdul Wasi Jokheo for not appearing in a case against the Lyari gangster, Arshad Pappu, as prosecution witnesses for the last one year.
The court also issued a show-cause notice to another police inspector Nasir Khan to appear in court on Oct 24 to offer an explanation for not appearing before court.
According to courts’ sources, the police officials are witnesses in a case (FIR No 174/06) registered by CID Sindh under Sections 13/E, 4/5, etc but they are avoiding to appear in their court as prosecution witnesses.
Arshad Papu was arrested by police in murder, attempt to murder, police encounter and dacoity cases.
The court directed the high-ups of the police department to arrest the inspectors and produce them on Oct 24, the next day of hearing.
