KARACHI: Jail chief summoned for not sending UTPs to court

By A Reporter

KARACHI, Sept 21: The additional district and sessions judge-4, West, Hafeeza Usman, on Friday issued a notice to the superintendent of the central prison to appear in court on Oct 4, in connection with a complaint against him about non-production of under-trial prisoners in court.

The court took the action on an application filed by Samiullah, son of Bakht Rawan, who stated that UTPs Kashif Raza, son of Mohammad Rafiq, and Fahad Ahmed, son of Aziz Ahmed Khan, had been arrested in a case of street crimes on June 25, 2007 in the limits of Orangi Town police station.

An FIR 126/07 had been registered against the accused under Sections 392/34 of the Pakistan Penal Code. One of the accused Nouman is still at large.

The complainant alleged that the jail superintendent was intentionally not permitting the accused to be produced in court for trial.

The court directed the jail official to appear in court and clarify his position.

Kazmi’s case

The judicial magistrate-VII, Central, Khadim Hussein Chand, on Friday issued a notice to the district attorney to appear in court on Sept 29 for arguments on a bail application of civil rights activist Mohammad Iqbal Kazmi in a dud cheque case registered against him at Liaquatabad police station on Aug 22, 2007.

The applicant stated that the case (FIR No 98/07) registered under Section 406 of the Pakistan Penal Code was a conspiracy against him.

He stated that a fresh case against him had been registered in retaliation by the police as he had already filed petitions in the Supreme Court of Pakistan and the Sindh High Court against Muttahida Qaumi Movement chief Altaf Hussain and Adviser to the Sindh chief minister on Home Affairs Waseem Akhtar pertaining to the May 12 mayhem.

Mr Kazmi said that the complainant (Mohammad Iqbal, son of Mohammad Ikram) had also got another case (FIR 548/06) registered against him under Section 489-f and 506-b and he had already got bail in the case.

He said that neither any amount of the complainant had been outstanding against him nor he had been under obligation of any kind.

He said various courts had granted him bail in six cases of the same nature, but the registration of a fresh case was beyond him.
