KARACHI, March 6: The Sindh High Court has decreed a suit for damages against the Karachi Electricity Supply Corporation to the tune of Rs2.835 million.
The suit was instituted by Ms Khalida Saleem through her counsel, Nasir Maqsood, under the provisions of the Fatal Accidents Act to claim Rs3.5 million her 32-year-old husband’s death on August 12, 1992.
The deceased was survived by the 29-year-old plaintiff, a one-year-old daughter and 60-year-old parents.
Salim, a clerk in the postal life insurance department, was going to office on his motorcycle via Bhadur Yar Jang Road when he was electrocuted by a live wire lying on the road near Soldier Bazaar.
The plaintiff’s counsel contended that the wire had broken loose from an electric pole and was lying on the slushy road in the rainy season.
The Karachi Electricity Supply Corporation was responsible for protecting citizens from the electric current running in its wires and installations.
But the corporation took no precautionary measures and did not remove the wire from the road.
It was guilty of gross negligence and liable to compensate the dependants of the victim.
Decreeing the suit to the extent of Rs2.835 million, Justice Khilji Arif Hussain ordered the KESC to pay markup at the rate of 12 per cent till the day of payment.
