LAHORE, Feb 22: The Lahore High Court will take up on Friday (today) a petition seeking a stay order against Basant, and challenging issuance of the Punjab Kite Flying Rules, 2007.

Through counsel Muhammad Azhar, the petition has been filed by Muhammad & Ahmad Law Firm, praying to suspend the person who amended the ordinance until a decision of the court on his earlier pending writ petition.

The petitioner also requested to allow him to make some necessary amendments to his pending petition according to new facts and circumstance.

He further prayed that the Kite Flying Rules, 2007, and two notifications allowing kite-flying activities, dated Feb 13, 2007, may kindly be declared illegal, ultra vires Article 9 of the Constitution.

It was further prayed that suitable orders be passed for recovery of public money wasted in the shape of wire antennas and advertisements published in newspapers.

The counsel through his earlier petition had assailed Punjab Prohibition of Kite Flying (amendment) Ordinance 2007 terming it against the public interest and in complete derogation of the directions and ban imposed by the apex court.

He had stated that there was no sound reason for promulgating the ordinance and the Punjab governor did not satisfy himself for the exercise of jurisdiction under Article 128 of the Constitution.
