KARACHI, Feb 3: The Federal Service Tribunal has ordered the expunction of adverse remarks from the annual confidential report (ACR) of an income tax commissioner.

Income Tax Commissioner for Appeals Hyderabad Abdul Ghani Channa, submitted through Advocate G.M. Lakho, that adverse remarks were made in his ACR for the August 2001-June 2002 period without specifying his ‘weak points’ and without advising him to improve in ‘specific areas’.

The counter-signing authority simply agreed with the reporting officer without admittedly seeing his work. No inquiry was conducted.

Earlier in 1998 the Supreme Court declined leave to appeal against an FST decision upholding his plea against supercession observing that his work had been assessed ‘good’ and ‘very good’ during 18 years of his service in the department.

Observing that the appellant had been condemned unheard and that no prior warning was given to him, an FST bench comprising Qazi Mohammad Hussain Siddiqui and Rashid Ali Mirza allowed the appeal.
