KARACHI, Dec 7: The Sindh High Court directed the Dow University of Health Sciences (DUHS) on Thursday to admit a student excluded from admission to MBBS on a ‘hyper-technical’ ground.
Azka Sadiq applied for admission after passing her A-level examination well in time but could not furnish her English language test result.
The test was held only two days before the last date for submission of applications and she got the result card after expiry of the date. She scored eight points against the minimum requirement of 5.5 points and informed the varsity authorities verbally.
She received the result card in due course and submitted it before the finalisation of the list of successful candidates.
She was denied admission because of her failure to submit the result card along with other documents.
Ms Sadiq moved the high court against the university and a division bench comprising Chief Justice Sabihuddin Ahmed and Justice Faisal Arab observed that an individual could not be deprived of a substantive right on a hyper-technical ground.
It rejected the varsity’s contention that the entire list of candidates would have to be revised if her name was included belatedly.
In view of the special circumstances, the bench ordered her admission as a special case. Advocates Ghulam Qadir Jatoi and Minhaj Farooqui appeared for the petitioner.
