PESHAWAR, Nov 24: The Peshawar High Court on Friday issued non-bailable arrest warrant for a surgeon charged with depriving a child of a kidney.

Justice Dost Mohammed Khan ordered police to ensure appearance of the accused, Dr Ali Gohar, on the next hearing.

He was hearing a petition filed for cancellation of bail granted to the doctor by an additional district and sessions judge.

Dr Gohar had filed a pre-arrest bail petition before the court of additional district and sessions judge after an FIR was lodged against him with the University Town police by Ziarat Gul, father of Ameenullah. His pre-arrest bail was confirmed by the lower court on August 11.

The government had ordered an inquiry in the wake of the incident, which went in favour of the accused. The inquiry suggested that the doctor had ‘not removed a functional kidney’ of the child.

The FIR, based on the opinion of the legal branch of police, was registered on June 27 under section 324, 336 and 337 of Pakistan Penal Code.

The complainant submitted that he had taken his son to the surgeon who carried out an operation on him at a private hospital. He said that since the boy was not feeling well after the surgery, they took him to a government hospital where they were informed that one of his kidneys had been removed.

The doctor refuted the allegation and claimed that an ultrasound examination of the boy, conducted by a known specialist, transpired that one of his kidneys was dead. To further confirm the report, another ultrasound was conducted which verified the same fact, he added.

The doctor contended that since no kidney transplantation centre or storage facility was available in the province, a healthy kidney would be of no use to him.

The NWFP chief minister has announced Rs200,000 grant for the treatment of the boy and strict action against the doctor.
