KARACHI, Nov 21: The Sindh High Court barred on Tuesday further constructions on a residential plot being used to raise a commercial complex and restrained the builder from creating third party interest.
The Karachi Building Control Authority moved an urgent application for attachment of the unauthorized structure as the builder, who had sanction for ground-plus-two-storey one unit bungalow on plot number 50, Block 3, Bahadurabad Muslim Co-operative Housing Society, constructed third and fourth floors consisting of flats under the cover of an ‘ex parte’ stay order.
When the KBCA demolition squad visited the site on Nov 8, hot water was thrown on it from the fourth floor.
The New Town police, instead of assisting the squad, sided with the builder and asked it to leave without doing its job. The SHC nazir, meanwhile, failed to inspect the site.
The KBCA moved its application in a pending suit instituted by the builder.
Justice Munib Ahmed Khan, who heard the KBCA plea, heard the submissions made by the KBCA counsel, Shahid Jamil Khan, and Advocate Umar Soomro for the builder, who maintained that a regularization application has already been submitted to the authority. Advocate Shahid Jamil contradicted the claim.
The court gave the nazir three days more to inspect the site and submit his report.
Further hearing of the suit and of a contempt of court application moved in it by the KBCA was adjourned to November 29.
