KARACHI, Nov 17: A division bench of the Sindh High Court, comprising Justices Sarmad Jalal Osmany and Ali Sain Dino Metlo, on Friday allowed the Karachi Water and Sewerage Board (KWSB) to remove the debris of the demolished structure at the Sabzazar Lawns on Sharea Faisal as the rubble was an eyesore that must be removed before the Ideas 2006 exhibition.
Ousted contractor M. Javed contested the application as, he said, the removal of debris would destroy the evidence in his pending case.
Another division bench, consisting of Chief Justice Sabihuddin Ahmed and Justice Faisal Arab, issued notice to Baldia Town and city district government officials for demolishing structures on a Yousuf Goth plot allotted to petitioner Samad Brohi. The allottee submitted through Advocate Mohammad Nawaz Shaikh that he had a court stay order in his favour.
The bench also allowed Saqib Hammad, student of Quaid-i-Awam University of Engineering, Science and Technology, Nawabshah, to appear in his forthcoming semester examination.
DEMOLITION STAYED: A division bench of the Sindh High Court, comprising Justices Sarmad Jalal Osmany and Ali Sain Dino Metlo, stayed a court order for demolition of five flats in Uzma Apartments, Clifton.
The petitioners, owners of the flats, stated through Advocate Gohar Iqbal that they were innocent purchasers without notice and the builder was responsible for whatever violations were committed in the construction of the housing complex. They sought time for seeking regularisation from the Karachi Building Control Authority (KBCA).
NAB CONVICTS’ PLEA: A bench, headed by Justice Osmany, heard arguments in petitions moved by Iqbal Ahmed Turabi, Syed Hasan Raza and others convicted under the National Accountability Bureau (NAB) Ordinance against denial of remissions allowed to other prisoners under Article 45 of the Constitution.
NAB deputy prosecutor-general Shafaat Nabi Sherwani argued that the president’s power of pardon or amnesty under Article 45 was absolute.
