PHC cancels bail of accused: Dishonouring of woman in public

PESHAWAR, Oct 30: The Peshawar High Court on Monday cancelled the bail granted by a subordinate court to a person charged with publicly stripping a woman last year. Chief Justice Tariq Pervez Khan observed that accused Umer Khan did not deserve concession of bail. The accused was arrested from the courtroom soon after announcement of the order.

The bench granted an application filed by Ms Parveen in which she had sought cancellation of the bail granted to the accused by a subordinate court of Karak district.

Advocate Muhammad Ameen Khattak contended on behalf of the applicant that the accused was charged with a non-bailable offence and there was enough evidence on record to connect the accused with the offence.

He argued that the victim had levelled directly charged the accused in the FIR and in view of the fact that the offence carried death penalty the accused was not entitled to bail.

According to the prosecution both the parties have old enmity between them. It was alleged that a female relative of the accused eloped with a male relative of the woman.

On Oct 13, 2005, the accused stopped the woman in a market and stripped her of clothes and paraded her in public in that condition. In the meantime, her father-in-law came on the place of incident and covered her with his chadar.

He took her with him but when they reached home the accused also came and started aerial firing. He snatched gold earrings and money from her.

The FIR was lodged at PS Takhte Nusrathi in Karak and the accused was arrested. But he was enlarged on bail by the district and sessions judge on Nov 26, 2005.
