ISLAMABAD, Oct 5: Federal Tax Ombudsman (FTO) Justice (retired) Munir A. Sheikh has asked the Central Board of Revenue (CBR) to finalise refund of a complainant in accordance with law.

The ombudsman in his judgment observed that the complainant’s claims of refund have suffered from inattention on the part of the tax officials leading to an inordinate and exceptionable delay in disposal of the case.

The decision came following the complaint of M/s Al-Vera Enterprises (Pvt) Limited Sheikhupura, which complained against the sales tax department for not getting the refunds of tax which he paid on inputs used in exportable goods.

The justice asked the CBR to finalise the refund claims of the complainant as were found admissible under law on merits and where any claim on processing was found inadmissible and not in accordance with the provisions of law, the CBR would issue show cause notice before rejecting the same to enable the complainant to seek further remedy from a competent forum.

On its part, the complainant would supply all the missing documents and statements asked for and remove the objections raised by the respondents to enable them to process and decide the claims on their merits.

The compliance report be submitted within three months of the receipt of this judgment, said the FTO.
