KARACHI: High Court continues interim stay on ATC order: Army men hostage-taking case
KARACHI, Oct 4: The Sindh High Court on Wednesday, continuing interim stay on anti-terrorism court's order in army personnel hostage taking case being tried against four employees of former Chief Minister Balochistan Sardar Akhtar Mengal, adjourned the hearing till Oct 13.
The adjournment came on a request of applicant counsel Azizullah K Sheikh and Wazeer Hussain Khoso who informed the court that their application for registration of case against army personnel is fixed for arguments on Oct 7.
They prayed the court to adjourn the matter as application pending before session court be decided.
SHC's division bench, comprising Justice Sarmad Jalal Osmany and Justice Ali Sain Dino Metlo, granting request adjourned the matter till Oct 13 and ordered that in the meantime no order shall be passed by the ATC.
Mohammad Yousuf, brother of accused Mehboob Ali and relative of other co-accused, moved the SHC for injunction against ATC's trial proceeding until his pending application against army personnel before session court is decided.
He submitted that the SHO of Darakshan was asked to apprehend army personnel and take action against them who used to chase vehicles carrying Sardar's children from school but for reasons best known to him, he registered case on a complaint of army personnel.
ATC, which declared Sardar Akhtar also a chief of Balochistan National Party (Mengal) as absconder, is due to deliver verdict after concluding trial against Akhtar's four employees -- Nasarullah Mengal, Ghulam Hyder Langah alias Chappar, Mehboob Ali Satti and Ghulam Qadir -- for kidnapping two army personnel and making them hostage on April 5 in Karachi.
According to the prosecution, Sardar Akhtar Mengal, with other accused, kidnapped army Havaldar Qurban Hussain and Lance Naik Fayaz Ahmed from Darakshan area with intention to kill them when army personnel were going to their intelligence duty. Bail cancelled: A single bench of High Court of Sindh, comprising Justice Mohammad Moosa Leghari, on Wednesday cancelled the bail granted to Bashoo Mal, allegedly involved in a fraud case, and sent him to jail.
The bail was cancelled on an application moved by a physician of Civil Hospital
Karachi, Dr. Zahoor Ahmed Sheikh.
Earlier, the court had allowed bail to Bashoo Mal against surety of Rs 0.5 million in a fraud case. The accused, claimed to be a cotton broker had allegedly taken Rs 8,00,000 from Dr Sheikh to invest the amount in business.
The applicant, Dr. Sheikh prayed to cancel the bail and submitted that Bashoo Mal, who was granted bail earlier, threatened him and his family.
notice to KBCA: A division bench of High Court of Sindh, comprising Justice Mushir Alam and Justice Maqbool Baqar, on Wednesday issued notice to Karachi Building Control Authority and others for a date to be fixed by the office in a case against construction of a flat-type structure at a residential plot.
Petitioner Nadeem Ahmed submitted that construction of flat-type structure on residential plot, bearing no 565, Kathiawar Cooperative Housing Society, Gulshan Town-II, among the bungalow habitation area is a violation.
He also submitted that construction of G+2 type bungalow was allowed in the building plan approved by KBCA for the plot.
The petitioner also sought directives for the Karachi Building Control Authority, Town Building Control Officer and builder/owner to restore the construction in accordance with the approved plan.
