KARACHI, Sept 27: The additional district and sessions judge, Karachi East, on Wednesday repeated notice to the SHO of the New Town police station, directing him to explain that why he did not lodge an FIR against nominated officials of the Liaquat National Hospital despite court order.
The court on Aug 4 ordered the registration of an FIR against doctors, administration and paramedics of the Liaquat National Hospital on the application of Mohammad Kabeer who alleged that her wife Surraya and their newborn baby died on Nov 30, 2005 due to the deliberate negligence of the hospital's staff and despite court order the SHO of the New Town police station was not registering a case against them.
His counsel Tariq Hamza Khan submitted that police refused to register a case despite court order and prayed the court to take action against the respondent under Section 155 (d) of Police Order 2002.
ADJ Abdul Rehman Bhatti repeating notices to the SHO also sought his explanation for not obeying court order.
The applicant had prayed the court to order the registration of an FIR against Dr Quratul Arfeen, Dr Inayat, Dr Shagufta, Dr Farah, Dr Erum, Dr Aimen, Dr Sumita, Dr Waliullah, Dr S.M. Nadeem, Dr Azmat Ali Abedi, Medical Director Prof Salman Fareedi and Director of Finance Samiullah Baig.
NOTIFICATION SUSPENDED: The Sindh High Court on Wednesday suspended the city government's notification for dispossession of residents of Sherpao Basti in the Bahadurabad area.
The order came on the petition of 11 petitioners of Sherpao Basti against dispossession by the CDGK. They submitted that CDGK had no right to evict them from houses as their houses did not fall under the CDGK land but the Khatiawar Cooperative Housing Society’s.
The SHC's division bench comprising Justice Mushir Alam and Justice Mohammad Afzal Soomro after preliminary hearing of the petition issued notice to the CDGK and others for Oct 10 and in the meantime suspended its notification.
STAY CONTINUES: The Sindh High Court on Wednesday turned down a plea for vacating stay on elections of the Pakistan Film Producers’ Association.
PFPA's secretary Sami Dehalvi prayed the court to vacate the stay on the election scheduled to be held on Sept 29.
The court on Sept 22 stayed elections of the PFPA on THE petition of Saeed Rizvi, chairman of the PFPA.
The petitioner submitted that the names of members of Sindh (Karachi Circle) had been excluded by the secretary of the PFPA (Lahore Circle) for the forthcoming election. He said the act of the respondent was mala fide and in violation of fundamental rights of the petitioner and other producers of the Sindh.
Petitioner counsel Syed Haider Imam Rizvi requested for time to file counter affidavit on the respondent's comments. The SHC's division bench comprising Justice Sarmad Jalal Osmany and Justice Ali Sain Dino Metlo maintaining interim stay adjourned the hearing.
CONVICTION SET ASIDE: The Sindh High Court on Wednesday set aside the conviction of a man in a doublemurder case.
Mohammad Zaman was sentenced to life in prison by the additional district and sessions court (West) in July 2004 for murdering a woman and his brother-in-law.
According to the prosecution, the appellant axed to death Lal Bibi and her brother-in-law Qaiser Shah on Feb 23, 1999 in Orangi Town due to a property dispute.
The appellant preferred an appeal in the Sindh High Court against the conviction. His counsel Aamir Mansoob Qureshi contended that the prosecution case was full of doubt and the same was not supported by key prosecution witnesses.
He said the seized weapon was not sent to forensic laboratory for examination nor the medical report of the injured witness was sent before the trial court. He sought acquittal of his client from the murder charges.
The SHC's single bench comprising Justice Munib Ahmed Khan after hearing the case observed that the prosecution could not prove its case against the appellant and ordered his release if not involved in other cases.—PPI
