KARACHI, Sept 22: The Sindh High Court on Friday restrained an anti-terrorism court in Karachi from announcing order in army personnel hostage taking case on Sept 25. The case is being tried against four employees of former Chief Minister of Balochistan, Sardar Akhtar Mengal.The interim injunction came on an application of Mohammad Yousuf, brother of Mehboob Ali, and relative of other co-accused, who moved the SHC for injunction against ATC's trial proceedings.
The ATC, headed by judge Haq Nawaz Baloch, which declared Sardar Akhtar an absconder, is due to deliver verdict after concluding trial against Akhtar's four employees, Nasarullah Mengal, Ghulam Hyder Langah alias Chappar, Mehboob Ali Satti and Ghulam Qadir, for kidnapping two army personnel and making them hostage on April 5 in Karachi.
According to prosecution, Sardar Akhtar Mengal, with other accused, kidnapped army Havildar Qurban Hussain and Lance Naik Fayaz Ahmed from Darakshan with an intention to kill them when army personnel were going to their intelligence duty.
Applicant counsel Azizullah K Sheikh and Wazeer Hussain Khoso submitted that the applicant had filed an application before the Additional District and Session Court for registration of FIR against Qurban Hussain and Fayaz and if judgment is announced by the ATC, the same will affect the investigation of his application.
They said that the SHO of Darakshan was asked to apprehend army personnel and take action against them who used to chase vehicle carrying Sardar's children from school but for reasons best known to him, he registered the case on complaint of Army personnel.
SHC's division bench, comprising Justice Sarmad Jalal Osmany and Justice Ali Sain Dino Metlo, after preliminary hearing of application restrained the ATC from announcing order on Sept 25 and issued notice to AG Sindh for Sept 26.
POLLS STAYED: The Sindh High Court has stayed elections of Pakistan Film Producers Association, scheduled for Sept 29.
The interim order came on a petition filed by Saeed Rizvi, chairman, Pakistan Film Producers Association, against the order of the Director of Trade Organization, Ministry of Commerce, and deletion of names of some producers from voters’ list.
His counsel Rasheed A Rizvi and Syed Haider Imam Rizvi contended that the names of the petitioner, with all the members of Sindh (Karachi Circle), have been excluded by the secretary, Pakistan Film Producers Association (Lahore Circle).
They said this act is based on mala fide and in violation of fundamental rights of the petitioner and other producers of the Sindh.
SHC's division bench, comprising Justice Sarmad Jalal Osmany and Justice Ali Sain Deno Metlo, granting interim stay on the petition issued notice to respondents for comments.
Plea dismissed: A division bench of High Court of Sindh (SHC), comprising Justice Anwar Zaheer Jamali and Justice Zawar Hussain Jaffery, on Friday dismissed a plea seeking order against life imprisonment verdict in a narcotics case.
Appellant, Peer Mohammad, presently confined in Central Jail Karachi, was arrested with 38 rods of charas, including big and small, weighing about 4 kg and 100 grams from Muwach More Bus Stop.
It was submitted that the FIR against Peer Mohammad was registered on July 18, 2003, at Police Station, Anti- Narcotics Force (ANF), Clifton.
CHARGE SHEET: Administrative judge of anti -terrorism courts on Friday accepting charge sheet against accused, facing extortion charges, sent his case to ATC-III for trial.
Shahid Qadri is charged with receiving extortion from businessman Mustufa. He was arrested by Risala police after an encounter last month.
Police alleged that the accused along with absconding co-accused demanded Rs5,000 from complainant and threatened to kill him if demand was not fulfilled.
Investigation officer of case produced charge-sheet against the accused before AJ Justice Amir Hani Muslim of Sindh High Court for approval.—PPI/APP
