LAHORE, Aug 30: The family of Hafiz Mohammad Saeed, the amir of Jamatud Dawaa Pakistan, has said that the Punjab home department has not so far served them with the order of his detention.
Hafiz Saeed was taken in custody after midnight on Tuesday after the SP had told the family verbally that he was being arrested under Section 3 of the Maintenance of Public Order Ordinance but did not serve on them a formal order.
His counsel, advocate Nazir Ahmad Ghazi, told Dawn that he could not move the Lahore High Court against the re-arrest of Hafiz Saeed nor a plea for contempt of court because the home department order was not given either to the family or him.
He said the order was a necessary legal document to approach the LHC and the government was impeding the way of seeking justice from the superior court which amounted to violating the constitution.
