KARACHI: One more petition filed against KESC: Killer vehicle’s seizure ordered

KARACHI, July 6: Three petitions against the sufferings caused by the Karachi Electricity Supply Corporation to the people would be heard by the Sindh High Court on July 10.

A vacation division bench, comprising Justices Anwar Zaheer Jamali and Mohammad Afzal Soomro, issued notices to the corporation and the federal ministry of water and power in a third petition assailing frequent and prolonged power interruptions in the city. The petition has been moved on behalf of a non-governmental organization. Petitioner Sohail Shelan said the KESC has failed to maintain an essential public utility despite recovery of inflated bills. The power breakdowns have not only disrupted normal life but also adversely affected industrial and commercial activity in the port city. The students appearing in various examinations and the old and sick have been the worst sufferers of the corporation’s incompetence and inefficiency.

As an interim measure, the petitioner prayed, the KESC be restrained from resorting to unannounced and unscheduled loadshedding. The new owners should be directed to honour their commitment or the corporation be reverted to overall government control. The KESC should also be directed to compensate the consumers for the torture caused to them.

The bench ordered that the petition be fixed for preliminary hearing on July 10 when the two identical petitions raising the same issue are due to come up for hearing. seizure ordered: Justice Gulzar Ahmed of the Sindh High Court has ordered seizure of two killer vehicles and barred their transfer to prevent their sale by the defendant owners to frustrate possible decrees in favour of the legal heirs of their victims, who have approached the court for compensation.

Nineteen-year-old Muneeb Zafar was run over and killed by a rashly-driven truck on Feb 28. His parents sued for recovery of Rs 4.5 million as damages from the truck owner and driver on account of the losses suffered by them under the Fatal Accidents Act. Advocate Aamir Maqsood submitted on behalf of the plaintiffs that if the vehicle was not secured, they would by no means left to obtain satisfaction of any decree in their favour. He also requested the court to restrain the defendants from transferring the vehicle.

Issuing notices of the application to the defendants, Justice Ahmed the SHO of Federal B Area police station to attach the vehicle and directed the motor registration wing of the excise and taxation department, Lasbela, Hub district, to refrain from registering any transfer of the truck (No TKC-950).

The lawyer also sought attachment of bus (No P-0119), which ran over Samina Bibi, 35, and killed her on the spot. Her husband instituted a suit for recovery of Rs 3.5 million in damages and got a case registered at the Korangi police station.

Issuing notices to the defendant owner and driver of the bus, Justice Ahmed ordered the Korangi police station SHO to attach the vehicle and restrained the registration authorities of Hyderabad from allowing its transfer.
