HYDERABAD, May 29: The Hyderabad circuit bench of the Sindh High Court on Monday issued notices to officials of different departments to appear in the court on May 31, for cancelling a land agreement.
The officials are: EDO (revenue) of the Jamshoro district, Mukhtiarkar of the Thano Bula Khan taluka and deputy-director of the anti-corruption establishment, Hyderabad.
The petition was filed by Agha Tajamul Hussain.
He stated that he was the owners of land in Deh Uth Palan, Thano Bula Khan taluka.
He said that his name was entered as “khatedar” as no objection was raised by revenue officers at the time of land’s purchase.
He said that his sale deed was registered and mutation was also effected by officer concerned but the EDO (revenue) cancelled his title of property without holding inquiry and considering facts.
He said that no report regarding any manipulation on the part was submitted by Mukhtiarkar who was custodian of land record.
He said that cancellation of the title was in violation of section 164 of the Land Revenue Act (LRA) 1967.
He said that the EDO himself played all tricks as he neither sent any notice to parties through ordinary mode but it was directly published in newspaper to create harassment.
He said that the ACE deputy director was harassing the petitioner though he had no authority to initiate action against him.
He said that the act of the EDO was in violation of policies of federal and Sindh governments to encourage the business community to invest in their own country and give jobs to unemployed youth.
He said that it was tantamount to discouraging foreign investor and that was the reason that foreign investment was not taking place here.
He said that the section 41 of Transfer of Property Act also provided protection to a bonafide purchaser and the petitioner had spent huge amount on development of land on the basis of revenue record.
