PESHAWAR, May 17: The Peshawar High Court on Wednesday upheld the death sentence awarded by a trial court in Mardan to a man convicted of triple murder.
A two-member bench, comprising the Chief Justice Tariq Pervez Khan and Justice Ijaz Afzal, dismissed an appeal filed by the convict, Lajbar Khan.
The bench ruled that the prosecution had proved its case against the appellant and the evidence on record proved his involvement in the commission of the crime.
The appellant was charged by the prosecution of killing three persons of the same family. The deceased included Taza Gul, his wife Ahsania and his son Wahid. One of the daughters of the deceased, Taza Gul, was also injured. The incident had occurred in Mardan on Aug 18, 1999.
The additional district and sessions judge at Takhtbhai in Mardan had convicted the appellant on Aug 10, 2003, and awarded him capital punishment on three counts. The complainant in the case was Khan Said, brother of the deceased Ahsania. The motive behind the murder was a dispute over repayment of a loan amounting to Rs7,000.
GANGSTER CONVICTED: A gangster, Bacha Khan alias King, was found guilty by an anti-terrorism court on Wednesday of firing at a school bus and was sentenced to one-year rigorous imprisonment besides being fined Rs100,000.
The court, presided over by Shahjee Rehman Khan, acquitted the accused of charges under Section 7 of the Anti Terrorism Act, 1997, observing that the terrorism charges could not be proved.
The accused had attacked a bus of Peshawar Model School on Oct 3, 2005.
He had also manhandled the bus- driver.
The accused is known to be close to boys belonging to influential families and performed small illegal jobs for them, including beating up boys belonging to rival groups.
