KARACHI, March 1: An additional district and sessions judge, South, issued on Wednesday notice to the SHO of Clifton in a contempt of court application for not registering FIR against a police officer on the complaint of his estranged wife.
Judge Farzana Anwver Shah issued notice on the contempt of court application flied by Mehwish Khan, wife of SI Syed Kamran Hussain Rizvi.
The court, earlier, on Feb 27 had directed SHO Zia Hussain Rizvi to lodge an FIR against the inspector on an application of the complainant, Mehwish Khan.
According to the woman, she had been living with her two minor sons and mother at flat No 6, Plot No 3-C/27, Commercial Tauheed Street, Phase-5, DHA. She alleged that on July 23, 2005, her estranged husband came to her flat around 10:15pm. She said SI Kamran, who was drunk, started shouting outside her flat. She said he hurled expletives and tried to take away her son brandishing his pistol.
The woman said her estranged husband also threatened her of dire consequences.
She alleged that her husband also beat her up although she was eight-month pregnant at the time.
Mehwish Khan submitted that her husband came again next day and tried to snatch her son. She said she immediately made complaints to police emergency 15 and Clifton police station on phone. Later, she also lodged a complaint against her husband with the Clifton police.
The woman stated that she personally approached the SHO of Clifton and other police high-ups requesting them to initiate legal action against her husband and provide her protection. However, she said, the SHO and other police officials kept on giving her false hopes.
The judge in her order wrote: “The SHO is directed to register FIR of the applicant in 154 CrPC book, provided cognisable offence is made out.”
In her application under Sections 3, 4 and 5 of the Contempt of Court Ordinance, the woman submitted that she had appeared before the SHO of Clifton, and a duty officer recorded her statement on Feb 28. However, the police informed her that the FIR against a police official would be registered only after the permission of higher police officials.
