PESHAWAR, Feb 25: The case of killing of three boys, two of them brothers, in a police ‘encounter’, has been taken to the court of the district and sessions judge with a request to issue order for registration of an FIR against police officers involved.

Sabir Khan, father of the two brothers, filed a petition under section 22-A of the Criminal Procedure Code. The section 22-A gives sessions judges powers of the Justice of Peace and authorises them to order registration of an FIR.

Mr Sabir Khan said that police killed his sons, Turabzada, 15, and Nawabzada, 16, and his nephew, Khalid Hussain, 15, in a fake encounter on Feb 4 in the Chamkani police jurisdiction. He said the three were dubbed robbers.

The petition was filed through lawyer Azhar Yousaf who requested the court to order the police to register an FIR against the police party involved in the fake encounter.

Substantiating his claim that the encounter was fake, the lawyer maintained that some witnesses had seen the boys alive in the police custody.

Mr Sabir Khan said the three boys were innocent and had nothing to do with any gang of robbers.

The Peshawar SSP, the ASP and SHO of Chamkani, Sub-inspectors Riaz Khan and Abdul Bais, assistant sub-inspectors Amir Sultan, Granullah and Faqir Hussain, and constables Fazle Wahab, Momin Khan and Khatab Gul have been nominated as respondents in the FIR.

Another petition has been filed by Muslim Shah, brother of a rickshaw driver Islam Shah, who was also killed in the same ‘encounter’.

In Mr Muslim’s petition, Additional District and Sessions Judge Khwaja Wajihuddin has put the respondent officers on notice.

A posse of the Chamkani police on Feb 4 killed five people. The police claimed that four of them were robbers. They believed that the rickshaw driver used to help them escape after commission of an offence.

Some photojournalists had claimed that two of the alleged robbers were caught alive and killed by the police later.
