KARACHI, Feb 24: A division bench of Sindh High Court on Friday issued notice to A-G Sindh, CCPO Karachi and others for March 8 on a petition against detention of Pakistan People Party (Shaheed Bhutto) activists by the police.
Mushtaq Ahmed alleged that his brother Sarwar Mangi with his friends, Amir Bux and Dr Fayaz, was arrested by the Anti-Violent Crime Cell on Jan 15 when they were going towards 70-Clifton.
He said after two days, the police released Amir Bux and Dr Fayaz but kept his brother under illegal confinement without producing him in any court of law or mentioning any charges against him.
The court was prayed to order his production and release him after recording his statement, besides direction be given to register case against police officials for illegally confining the detainee.
SHC’s division bench, comprising Justice Ghulam Rabbani and Justice Zia Pervaiz, after preliminary hearing of the petition issued notice to respondents for March 8.
SET ASIDE: A division bench of Sindh High Court Friday set aside trial court order regarding conviction of an activist of the banned Harkatul Mujahideen Al-Alami in an explosive, murder and encounter cases and remanded back case for its disposal in accordance with law.
Kamran alias Atif, also wanted in a conspiracy case to assassinate President Geneal Pervez Musharraf who carried Rs3 million reward on arrest, was prosecuted on charge with killing a passerby woman and attempting to kill a policemen in a shootout on May 19, 2004, in the limits of Taimoria police. He was further charged with possessing of arms, ammunition and other explosive material.
SHC’s bench, comprising Justice Mohammad Afzal Soomro and Justice Rehmat Hussain Jaffery, observed that conviction and sentence awarded to the appellant, awarded by trial court, were illegal.
Setting a side the trial court order, the court remanded back the case to the trial court for hearing final arguments.—PPI
