Widow seeks help to get property back


NAUSHAHRO FEROZE, Dec 1: A widow and her sons have appealed to the superior judiciary, the president and the Sindh chief minister to help them get possession of their 43.05 acre of land and other property. Speaking at a press conference, Sadori, the widow of Jan Mohammad Tagar, her sons Allah Rakhio and Qasim, said here on Thursday that Jan Mohammad was killed in 1974 when his sons, Allah Rakhio was four-year-old and Qasim was not born.

She said the accused had been acquitted by the court.

After that she was continuously under threats of being forcibly dispossessed of her husband’s agricultural land.

She made an application to the then Sukkur commissioner, requesting him for taking the agriculture land measuring 43.05 acres, their house, buffaloes and weapon 1-c gun and other property under the Court of Wards Act.

After formalities, the agricultural land survey No. 1, 2, 3, 7, 8, 244/A, 273, 266 and 267 in Deh Panjo, Naushahro Feroze taluka, was taken into possession by the court of wards, vide government of Sindh, letter No. 7-85-79/RE, 41(111) 1979 in superintendence of it.

A notification under the court of wards act was also issued accordingly.

They complained that the court of wards did not take any care of the widow and orphan’s welfare, education etc while widow has been approaching the court of wards/ revenue officials for payment of money earned from the produce of their said agricultural land but all in vain.

They said officers of the court leased out the said land to alleged killers of deceased Jan Mohammad.

On attaining maturity, the sons again applied for the payment of lease money of the land, gun and release of the land to them.

The correspondence was made and finally the deputy commissioner addressed to assistant commissioner directed for submitting detailed report within seven days.

On July 10, 1993, statements of the widow and two sons were recorded by Mukhtiarkar but the land, lease money, revolver and other property were not returned.

The widow told reporters that on July 17, 2003, the EDO, revenue, directed Mukhtiarkar to verify the record and submit report about legal heirs of deceased Jan Mohammad Tagar, the husband of the widow, so that properties be released to applicants.

The Mukhtiarkar in response to above letter, submitted his report and named widow Sadori, her two sons Allah Rakhio and Qasim as legal heirs of deceased Jan Mohammad.

The EDO revenue in his letter dated January 26, 2004, intimated all the facts along with copy of statement of properties to the secretary of the Board of Revenue Sindh, requesting permission to release 72 paisas share of land in the said survey numbers to legal heirs.

The additional secretary of the Board of Revenue Sindh, accorded sanctions under section 40(i) of the Sindh Court of Wards Act on April 29, 2004, to release property of estate (SK-54) to extent of 72 paisas share out of said survey numbers of Deh Panjo in favour of Sadori and her sons Allah Rakhio and Qasim Tagar.

The EDO revenue directed Mukhtiarkar for recording necessary entries in relevant record of rights in favour of applicants without further delay.

The Mukhtiarkar directed tapedar to record entry as per directives of the additional secretary of the Board of Revenue and the EDO in names of applicants.—Correspondent
