KARACHI, Nov 18: Justice Munib Ahmed Khan of High Court of Sindh (SHC) on Friday issued notice to the State for Nov 21 in bail applications filed by Aklhaq Ahmed, consultant to KBCA’s Chief Controller Brig (Retd) S A Nasir and Moinuddin Sharif, another KBCA officer.
Earlier, Provincial Anti-Corruption Court rejected the bail applications of the accused on Wednesday holding the same to be premature at a stage where investigations are being conducted.
Barrister Raza Hashmi is appearing for Aklhaq Ahmed while Moinuddin was represented by Saleem Samoo advocate. Both are accused of massive corruption, colluding with other officials to grant illegal construction plans. The accused were allegedly involved in illegal construction of dozens of buildings in PECHS (blocks 2 and 3) and Jamshed Town area.
CONTEMPT NOTICE: Justice Mohammad Sadiq Leghari of High Court of Sindh (SHC) on Friday issued contempt of court notices to DIG, Operations, Sukkur police range, DPO Rana Sanaullah, SHO Qalb-i-Abbas Shah and others.
The court ordered them to appear in person before the court on Dec 5 to explain their position why they have failed to arrest a nominated accused in a murder case.
The contempt of court application was moved by Abdul Wahab, advocate, nephew of Gul Hasan who was killed by six persons in a property dispute a year back.
The said police officials, earlier appearing before the court in a constitutional petition filed by Wahab Baloch, held out an assurance that they would arrest the alleged killers at which the said petition was disposed of.
BAIL GRANTED: A division bench of High Court of Sindh, comprising Justice Rehmat Hussain Jaffery and Justice Ali Sain Dino Metlo, on Friday granted bail to two accused in a case of possessing contraband items.
Mohammad Ashraf Kazi moved the bail applications of Jewat Roy and Rano Mal arrested by the Thatta Police on June 14 allegedly after the recovery of 82 bottles of wine and one kg of charas from the vehicle they were travelling in. Their vehicle was intercepted at Railway gate, Makli, a kilometre away from Thatta city.
The counsel for applicants submitted that the accused are sugarcane growers and not dependent on sale proceeds from contraband items as alleged by the Excise Police.
He also contended that the raiding party, headed by Excise Inspector Mir Mohammad Abbasi , complainant also first entered the weight of recovered charas to be one kilogram and later 0.5 grams were added so that offence fell under section 9 (c) of CNS ordinance punishable by death or life imprisonment instead of seven year sentence carried by section 9 (b) of the said act.
ILLEGAL CONSTRUCTION: The fourth floor shall not be allowed to be constructed and be demolished if already raised, ordered a division bench of High Court of Sindh (SHC), comprising Chief Justice Sabihuddin Ahmed and Justice Muhammad Athar Saeed, here on Friday while hearing a constitutional petition filed by Mian Sons Textile Limited against Lucky Textile Mills and Karachi Building Control Authority.
The petitioner, moving the court, maintained that due to illegal construction and activity of the respondents, labourers at his mills were suffering from different problems and even a lady worker had fallen unconscious.
When the matter came up for hearing before the bench on Friday, the counsel for respondents submitted that the building has been regularized by the KBCA. He submitted that the owner of the mills has paid Rs3.7 million as regularization fee.
Shahid Jamiluddin , counsel for KBCA, verified the fact and said that the KBCA had allowed regularization of the building from ground-plus- three. The fourth floor has been declared illegal and demolished by the department, KBCA counsel stated.
The bench, after a detailed hearing, declared ground-plus-three storeys as regularized while directing the KBCA that fourth floor shall not be allowed to be constructed and if already raised, it shall be demolished.
The bench, with the above orders, disposed of the petition.—APP
