KARACHI: Nazir appointed to report on violation: Illegal construction
KARACHI, Nov 11: A division bench of High Court of Sindh (SHC), comprising Justice Musheer Alam and Justice Zawwar Hussain Jaffery, on Friday appointed Mr Zaheeruddin, Nazir of SHC, as commissioner to report about alleged illegal constructions by KCCI in PMA building.
The bench was hearing a constitutional petition filed by Fair Trade Corporation, a tenant in the same building. The petitioner maintained that the KCCI encroached an open duct in front of his office and constructed a room depriving the co-sharer of fresh air and proper ventilation.
During the course of hearing, the counsel for KBCA admitted that open space was transformed into a room. The counsel for KCCI on a query by the court sought time to seek instructions and said at present he was unable to state any thing about the stage of construction at the open space.
The bench then ordered the Nazir of SHC, Mr Zaheeruddin, to visit the place and submit a detailed report within three weeks after which further hearing would be held. The KBCA was also directed by the bench to provide the original layout plan of the building to the Nazir during his visit to the place in dispute.
PETITION ALLOWED: A division bench of High Court of Sindh (SHC), comprising Chief Justice Sabihuddin Ahmed and Justice Muhammad Athar Siddiqui, on Friday allowed a constitutional petition filed by a local industrialist seeking exclusion of his name from Exit Control List (ECL).
Abdul Mateen Allahwala, director of Bela Automotive Limited, moved the court challenging inclusion of his name into ECL since 2001 and obstruction to his travel abroad.
Fauzia Rasheed, appearing for the petitioner, submitted that since 2003, State Bank of Pakistan (SBP) and HBL which requested for placing the name of her client on ECL, have recommended that his name may be deleted but for unknown reasons his name still exists on ECL and every time he has to take special permission through a cumbersome procedure.
Mehmood Alam Rizvi, Standing Counsel representing the State, said that his predecessor has written a number of letters to concerned ministry and reply is awaited.
However, the bench perusing the case papers and letters by SBP recommending dropping of petitioners’ name from ECL, allowed the petition observing that free movement is one of the fundamental rights of citizens.
NOTICE ISSUED: The Sindh High Court on Friday admitted for hearing appeals filed by two convicts against their conviction in kidnapping for ransom case and issued notice to the state.
Iqbal Hussain and juvenile Sheraz were sentenced to life imprisonment by an anti-terrorism court in Karachi on Sept 1 for kidnapping a school-boy Mohammad Anas for ransom.
Prosecution alleged that appellants kidnapped the boy when he was coming from the school on April 6 in Gulberg and demanded Rs 200,000 and 200 grams gold from the father of abductee.
SHC’s division bench, comprising Justice Rehmat Hussain Jaffery and Justice Ali Sain Dino Metlo, after preliminary hearing admitted the case for hearing and issued notice to state.
Meanwhile, the same bench dismissed bail application of a man in a drug case.
Ziaullah, along with others, was arrested by the Anti-Narcotics Force on June 10, 2004, from Gulshan-i-Iqbal. The ANF recovered 40.095 kgs of charas from their possession.
CONSPIRACY CASE: The Sindh High Court on Friday ordered production of a convicted leader of the banned Harkatul Mujahideen Al-Alami in the conspiracy case to assassinate President Pervaiz Musharaf.
The court was hearing appeals filed by activists of banned Harkatul Mujahideen Al-Alami against their conviction by trial court.
Mohammad Imran, Mohammad Hanif and Mohammad Ashraf Khan were found guilty of the offence and were sentenced to 10 years with a fine of Rs100,000 each by an anti-terrorism court in Karachi on October 18, 2003.
The prosecution alleged that the accused hatched a conspiracy to assassinate President General Pervez Musharaf due to government’s pro-US policies.
When the matter was taken up before SHC’s division bench, comprising Justice Rehmat Hussain Jaffery and Justice Ali Sain Dino Metlo, the court was told that Raza Ali Abidi, counsel of one convict Mohammad Imran, was not attending court despite serving of notices.
The court, issuing production order of convict Imran, also directed that a copy of order be sent to the appellant with specific directives that if he does not engage the counsel, the matter will be proceed in his presence.
