KARACHI: Hearing in sectarian killing case adjourned


KARACHI, Oct 28: The Sindh High Court on Friday adjourned the hearing of the state application seeking the shifting of the sectarian killing case against the activists of the Lashkar-i-Jhangvi to the Anti-Terrorism Court till Nov 22.

SHC’s division bench comprising Justice Mohammad Afzal Soomro and Justice Rehmat Hussain Jaffery asked the convicted activists of the LJ, Attaullah and Mohammad Azam to engage counsels to contest the state application.

The Sindh government filed an application against the order of administrative judge of the ATCs on July 29, 2002 refusing to accept the charge sheet against the respondents in the murder case of Fatmid Foundation Chairman Ehteshamuddin Haider with direction to the investigation officer to submit it before the concerned magistrate as the offence does not fall into the schedule offence.

Ehteshamuddin Haider, also the brother of former Sindh governor and interior minister Moinuddin Haider was killed on Dec 22, 2001 in the limits of Soldier Bazar, Karachi.

Meanwhile, the same bench dismissed bail application of a man in a drug case. Mohammad Aslam was arrested by the police from Kalakot area Karachi on June 14, 2005 on the charges of selling drugs. Police recovered 1,500gm charas from his possession.

PLEA DISMISSED: The Sindh High Court on Friday dismissed the bail application of an ex-director of the Alliance Motors, facing corruption and fraud charges.

Mohammad Ramzan Khawaja along with the other directors is facing trial before the Accountability Court in Karachi. Prosecution alleged that the accused cheated the public by promising a hefty monthly profit on the invested amount, a sum of approximately Rs5 billion and embezzled the said amount invested by the public.

SHC’s division bench comprising Justice Ghulam Rabbani and Justice Azizullah M. Memon heard the case of the bail application. After hearing arguments of the counsels the court rejected the bail with direction to the trial court to dispose of the trial against the accused following the ruling of the Supreme Court in the Asfandyar Wali case.

BAIL GRANTED: The Sindh High Court on Friday grated bail to a suspended police officer, facing charges of corruption and misusing of official equipment.

Acting DSP Syed Rashid Iqbal, in charge of the DSP Headquarters in SRP Gulshan base, is charged with posting 30-40 policemen at his private cattle pen and misusing the official equipment, and receiving salaries of 200 policemen.

The Anti-Corruption Establishment on Oct 10, 2005 raided a cattle pen being run by a police officer at the Hub area and recovered official weapons and equipment from the spot.

Arguing on the bail application, his counsels Ilyas Khan and Mohammad Farooq submitted that the applicant was falsely implicated in the case as no evidence was found against him. They said that not a single person testified that he was deprived from his salary by the applicant and submitted that the case needed further inquiry.

SHC’s single bench comprising Justice Zia Pervaiz after hearing the case ordered to release the applicant on bail with a surety of Rs400,000.

TIME SOUGHT: The provincial law officer on Friday sought time Sindh from the high court to make a definite statement regarding the sentence of a prisoner, who claimed he had served his sentence.

The SHC’s division bench comprising Justice Ghulam Rabbani and Justice Munib Ahmed Khan was hearing the petition of Razaur Rehman seeking the release of his father Chudhary Munawwar Hussain Sindhu, who has served his sentence after being granted remission by the President of Pakistan.

The prisoner, who was ex-managing director of Pak Green Fertilizer Ltd and Multan Edible Oil Extraction, was sentenced to 20 years and Rs95 million fine by the accountability court in Karachi in bank default references. The matter has been fixed for Nov 1.—PPI
