LARKANA, Sept 30: A division bench of the Sindh High Court, Larkana circuit, on Friday ordered that the petition filed by Saeed Ahmed Jamali, a nazim candidate for Dadu district, challenging the educational qualification of Karim Bux Jatoi, a candidate for the same post, be placed before the chief justice on Saturday for necessary orders.

When hearing of the petition began the counsel for the respondent expressed reservations about a member of the bench.

The SHC order said: “This matter may not be placed before the bench in which one of us (Justice Hani Muslim) is a member.

“Learned counsel for petitioner Nafees Siddiqi has expressed urgency in the matter.

“Azizullah Buriro has filed vakalatnama received by fax of Hafeez Pirzado advocate of respondent (Karim Bux Jatoi) and photocopy of the statement wherein he expressed his inability to appear before the bench today (on Friday).

“In view of above the matter may be placed before the chief justice tomorrow (on Saturday) for necessary orders so that the matter may be placed before another bench at the principal seat in Karachi,” the order stated.

The circuit bench at the Larkana comprising Justice Zia Pervez and Justice Hani Muslim had issued notice on Thursday for September 30, 2005 to respondents after hearing arguments of Nafees Siddiqi advocate of Saeed Jamali.—PPI
