KARACHI, May 17: The additional district and sessions judge, South, Syed Inamur Rahman, acquitted on Tuesday a man, of furnishing fake sureties in courts. Qari Ghulam Murtaza was booked by the City Court police under Section 420, 419 and 471 of the Pakistan Penal Code in 1999.
It was alleged that the accused along with co-acused Liaquat, Nasim and Mohammed Baloch furnished forged documents as bail sureties in different courts.
However, the judge exonerated him from all charges for want of incriminating evidence against him.
ARMY OFFICER’S CASE: The additional district and sessions judge, South, Farzana Iqbal, recorded statement of an army officer in the case of Lt-Col (Retd) Zargham Mirza, who has filed a direct complaint against Major (Retd) Noor Karim for submitting a false statement against him.
Major Rashid Bashir, Station Staff Officer at Sibi, deposed before the court that Zargham Mirza had been retired as lieutenant colonel after completing his “long and meritorious service in the army”.
Judicial magistrate Rahmat Moro had earlier dismissed the direct complaint of Mr Mirza after recording the statements of over a dozen witnesses. The main ground for dismissing the major’s complaint was a fake letter allegedly sent by Major (Retd) Noor Karim to the court through post. The letter stated that Major Zargham was found guilty in the court of inquiry commission.
Major Rashid Bashir, who was summoned by the court on the application of Zargham Mirza, stated that he had prepared the retirement documents of the complainant when he had been posted in Karachi.
He said the statement of Major (Retd) Noor Karim about Lt-Col (Retd) was baseless and false as he was never found guilty in the court of inquiry commission.
Major Mohammed Zargham Mirza had lodged a direct complaint before the judicial magistrate for registration of criminal case against 20 respondents, including Jamil Yousuf and A. D Khawaja, under section 182, 500 and 506 of the Pakistan Penal Code.
According to the army officer, he was implicated in a false case by the respondents, who hatched a conspiracy to defame the Pakistan Army.
In his complaint, lodged with the permission of 5 Corps, Major Mirza stated that on Jan 9, 2000 a woman, Saba Ibad, knocked at his door to make a phone call. She left the army officer’s residence along with her cousin, Hasan Abidi, who reached there after 20 minutes.
The major stated that the woman along with her cousin again visited his house after two days, but he refused to help them any more and informed the CPLC.
He submitted that Saba, being followed by the CPLC men, reached his residence on Jan 13. He said the woman was moved to her parents with Mr Shaheena Mehmood of the CPLC.
On the same day, Abaduddin, the father of the woman, lodged an FIR under section 11 of Huddod Ordinance with the Baloch Colony police.
However, later the matter was taken up by the military court where the father of the woman deposed that he was forced to get the FIR lodged.
Those made respondents in the complaint included: Zaeem Iqbal, ASP, Lubna Tiwana, then SHO of Women Police Station, Inspector Abdul Hakim Bangash, Azhar Ellahi and Sharf Memon.
