KARACHI: SHC issues notices to Customs authorities: Refund of duties

KARACHI, May 9: The Sindh High Court decided on Monday to reissue notices in a contempt case against the Customs authorities for not refunding the duty and taxes recovered on import of 50 vehicles under the ‘yellow cab’ scheme in 1995. The petitioners, M/s Ghandhara Nissan Diesel Ltd, submitted through Advocate Aziz A. Shaikh that despite exemption under the relevant notification, they were not allowed the benefit of duty-free import. They approached the high court and their plea was allowed. The Customs authorities undertook to refund the wrongly charged and recovered amount by Jan 15, 2003.

The Customs authorities failed to honour their undertaking and the petitioners moved the court again for contempt proceedings. A division bench disposed of the application in view of pendency of an appeal involving the same subject matter. Advocate Aziz Shaikh sought a review of the disposal order as no appeal in respect of the same subject was pending before the court.

Recalling the earlier order, Justice Mushir Alam, who was a member of the division bench that heard the previous application, issued notices to the alleged contemners and Deputy Attorney-General Nadeem Azhar Siddiqui for a date in office.

SUMMONS ISSUED: The high court office, meanwhile, issued summons to 11 defendants for Tuesday in a suit moved by a cable operator.

Alleging malicious prosecution, Haji M. Saleem Awan submitted through Advocate Nasir Maqsood that he was harassed and wrongfully proceeded against for copyright infringement of Star TV programmes. He sought Rs100 million as damages for actual business losses, mental torture and loss of reputation and goodwill suffered by him.
