PESHAWAR: Police notice to a woman: court summons SHO

PESHAWAR, March 19: Peshawar district and sessions judge Hayat Ali Shah sought comments from the SHO of C-Division police station on Saturday regarding issuance of a notice to a woman for expulsion from the jurisdiction of the said police station. The court issued notice to SHO Shahid Khan and fixed March 22 for next hearing. The order was issued following an application filed by the woman, Hidayat Bibi, stating that the police were hand in glove with her rivals, hence she was ordered to leave the area.
The SHO had issued a notice to the woman on March 14 on a plain paper, directing her to vacate her residence within a week.
He said he had taken the step on the complaint of the inhabitants of the area. He alleged that the woman was involved in ‘immoral’ activities.
Advocate Nasrun Minallah appeared for the applicant and contended that the SHO had no legal authority to expel a woman from the jurisdiction of his police station. He argued that the woman had been victimized by the police.
The applicant had killed her husband Khaistha Khan and an ASI of police, Roshan Khan, in 19997, claiming that her husband was forcing her to indulge in immoral activities.
Recently she had filed a case of habeas corpus in the court of Mr Hayat Ali Shah, stating that her daughter Mussarat was abducted by her husband Iftikhar.
On the court’s order, Mussarat was recovered and she decided to live with her mother. In the meantime, Hidayat Bibi’s second husband Wazir Khan filed an FIR against her charging her of adultery. She was arrested by officials of Faqirabad police station and later released on bail.
In the application, Hidayat Bibi said the police had been taking revenge from her for the killing of their colleague.
The SHO of C-Division police station had acted in connivance with her son-in-law Iftikhar and former husband Wazir Khan, she added. She said she had never indulged in any immoral activity. If she was of bad character she would not have killed her husband and a cop, she added.
