KARACHI: Reference against banker dismissed


KARACHI, Feb 17: An appellate bench of High Court of Sindh, comprising Justice Sarmad Jalal Osmany and Justice Azizullah M. Memon, on Thursday dismissed a reference against Younus Dalia, former president of Habib Bank Limited.

The reference was sent by presiding officer of Special Court for Offences in Banking Circle in which it was stated that accused Younus Dalia who was admitted to bail by SHC is misusing the concession of bail. The accused did not attend at least seven different hearings during March and April last, the reference said.

The bench on Thursday, hearing the counsel for the accused, dismissed the reference. In this particular case, Younus Dalia allegedly caused a loss of Rs 18.58 million to HBL by releasing equivalent security.

HEARING PUT OFF: The Sindh High Court on Thursday adjourned the hearing of appeals filed by activists of Harkatul Mujahideen Al Alamai against their conviction in a conspiracy case to assassinate President General Pervez Musharraf.

The matter could not proceed due to paucity of time. SHC's division bench, comprising Justice Sarmad Jalal Osmany and Justice Azizullah M Memon, put off hearing to date to be fixed by office.

Harkats' activists Mohammad Imran, Mohammad Hanif and Mohammad Ashraf Khan were sentenced to 10 years RI for offence of conspiracy with fine of Rs. 1,00,000 each by Anti Terrorism Court (ATC) Karachi on Oct 18, 2003. The court, however, acquitted Ranger's ex-inspector Waseem Akhtar and Sharib Arsalan Farooqui giving them benefit of doubt in said case.

Prosecution case was that the accused planned to assassinate President General Pervez Musharaf and fitted explosive in a vehicle on Shahrea Faisal to blow the convoy of the President but failed to do so.

ORDER RESERVED: Justice Amir Hani Muslim of High Court of Sindh on Thursday reserved judgement in a suit for damages worth Rs 17.70 million against KESC. Ali Raza, 7, sued KESC through his counsel Nasir Maqsood.

The plaintiff maintained that he was going to buy some grocery when he accidentally touched an open circuit box of the KESC. As a result, the boy's left hand was crippled and he also lost potency. The bench after detailed arguments by the counsel for the plaintiff and the counsel for KESC, reserved judgment.

BLAST CASE: An anti-terrorism court in Karachi on Thursday reserved judgment in a trial against an activist of the Harkatul Mujahideen Al Alami in a petrol pump blast case.

Kamran alias Atif was charged with causing a bomb explosion at a shell petrol pump in Azizabad on May 15, 2003. Concluding the final arguments, the defence counsel Nadeem Shahzad Hashmi questioned the prosecution case. ATC Judge Aley Maqbool Rizvi after hearing arguments of both the sides reserved the judgment till Feb 25. -APP/PPI
