LAHORE, Dec 14: The Pakistan Law and Justice Commission is reported to have proposed to the Ministry of Law, Justice and Human Rights legislation on execution of bail bonds and registration of contracts.
The two legislations are, according to sources, recommended by Lahore High Court Chief Justice Iftikhar Husain Chaudhry who wants sections 513 and 514 of the Criminal Procedure Code and the Registration Act to be amended for the purpose.
The proposed amendment to the Cr PC is aimed at allowing the movable property also to be accepted by courts for the purpose of bail. The law provides for only immovable property to be the basis of bail bond.
However, courts have been facing certain difficulties in assessing the immovable property for the acceptance of bail bonds. The LHC chief justice recommended to the Pakistan Justice and Law Commission to also provide for movable property to be accepted as bail bond.
As and when the National Assembly gets the two Cr PC sections amended and the new legislation is enacted, sureties will be allowed to deposit in an authorised bank cash of the like amount as bond for bail.
As for the other law which requires an amendment to section 30 of the Registration Act, the registration of all contracts and powers of attorney will be mandated to avoid parties (to contracts) going back on their agreements and complicating the legal process for redressal of grievances in law courts. The breaking of such contracts has frequently been witnessed in deals related to the real state in particular.
