KARACHI: Local govt commission summons nazim: MDA, LDA devolution issue


KARACHI, Nov 2: The Sindh Local Government Commission has asked City Nazim Naimatullah Khan to appear before it on Nov 18 along with all relevant record in connection with the failure to withdraw his notifications regarding defunct Malir and Lyari Development authorities.

In a letter to the nazim, the SLGC referred to the notification Nazim/City/Secy/6279/2004 dated Sept 21, 2004, issued under nazim's signature specifying ad-hoc arrangements for the projects of the two authorities.

It pointed out that the decision recorded at serial No.1 & 2 of the minutes of the meeting held on May 17, 2002 circulated by the nazim secretariat vide no. Nazim/City/Secy/944/2002 dated June 5, 2002 specifying the Lyari Development Authority and the Malir Development Authority as projects headed by Project Directors.

It said that notifications bearing no. DCO/CDGK/2002/Do/ HRM/1543 dated June 24, 2002 provided for steering committees to manage the two authorities.

The letter said that the issue was examined by the Sindh Local Government Commission and it was found against the spirit of Section 182 sub-section 6 read with Section 52 of the SLGO 2001.

The letter to the nazim stated that the Sindh government had already requested vide letter no. PS/S.S (LG)/1(9)/2004/84 dated Sept 29, 2004 to withdraw your notification dated Sept 21, 2004 but no action had so far been taken while the government vide notification no. PS/S.S (LG)/1(9)/2004/83 dated Sept 29, 2004 had stayed the operation of your notification.

The commission regretted to note that the said notification dated September 21, 2004 had not been withdrawn as yet and whereas the commission reviewed the entire case and unanimously decided to provide an opportunity to nazim of being heard in person along with all relevant documents and record before starting proceeding under Section 25 of Sindh Local Government Ordinance 2001. -APP
